Настоящее Пользовательское соглашение регулирует использование онлайн-платформы YogaJoy, доступной по адресу yogajoy.space.

1. Принятие условий

Используя сайт, создавая аккаунт, получая бесплатный доступ, покупая доступ, активируя сертификат или просматривая материалы платформы, пользователь подтверждает, что прочитал, понял и принимает настоящее Пользовательское соглашение.

Если пользователь не согласен с условиями, он не должен использовать Сервис.

Принятие условий осуществляется в электронной форме: через чекбокс при регистрации, покупке, активации доступа или использовании Сервиса.

2. Возраст пользователя

Сервис предназначен только для пользователей старше 18 лет.

Создавая аккаунт, пользователь подтверждает, что ему исполнилось 18 лет.

3. Суть Сервиса

YogaJoy — это онлайн-платформа, предоставляющая пользователю временный онлайн-доступ к цифровому контенту и материалам, размещённым на платформе.

YogaJoy не продаёт отдельные видеофайлы, физические товары или индивидуальные занятия.

В зависимости от выбранного продукта доступ может включать:

просмотр видеозаписей йоги;

просмотр дыхательных практик, медитаций, специальных практик и других материалов;

просмотр живых онлайн-занятий через Zoom или другую онлайн-платформу;

доступ к видеоматериалам;

доступ к авторским программам;

доступ к клубным материалам;

доступ к подарочным сертификатам;

иные материалы, указанные на странице продукта.

Если для конкретного продукта не указано иное, пользователь может просматривать доступные ему видеоматериалы повторно и без ограничения количества просмотров в течение активного срока доступа.

Повторный просмотр разрешён только через личный аккаунт пользователя на платформе YogaJoy.

Скачивание, копирование, запись экрана, распространение, передача доступа третьим лицам и любое коммерческое использование материалов запрещены.

Материалы YogaJoy являются информационно-развлекательным, информационным, досуговым и практическим контентом. Они не являются медицинской услугой, медицинской рекомендацией, диагностикой, лечением, реабилитацией, физиотерапией, индивидуальной консультацией или персональным сопровождением пользователя.

4. Важное предупреждение о здоровье и безопасности

Контент YogaJoy носит информационно-развлекательный, информационный, досуговый и практический характер.

YogaJoy не оказывает медицинские, диагностические, лечебные, реабилитационные или физиотерапевтические услуги.

Практики, демонстрируемые на платформе, не являются медицинской рекомендацией, не заменяют консультацию врача и не являются официальной образовательной программой с выдачей профессиональной квалификации.

Йога, дыхательные техники, медитации и другие практики могут быть связаны с физической нагрузкой и риском травм, ухудшения самочувствия или обострения существующих состояний.

Перед просмотром материалов и перед самостоятельным выполнением любых практик пользователь обязан самостоятельно оценить своё состояние здоровья.

YogaJoy настоятельно рекомендует:

проконсультироваться с врачом перед началом любых практик, особенно при наличии травм, заболеваний, беременности, хронических состояний, операций, проблем с сердцем, давлением, позвоночником, суставами, дыхательной системой или других ограничений;

при возможности заниматься под наблюдением квалифицированного инструктора, который может лично контролировать технику, уровень нагрузки, положение тела и состояние пользователя;

выбирать только те материалы и практики, которые соответствуют личному уровню подготовки и состоянию здоровья пользователя;

выполнять любые движения аккуратно, без боли и без насилия над телом;

немедленно прекратить практику при боли, головокружении, тошноте, слабости, затруднённом дыхании, ухудшении самочувствия или любом дискомфорте.

Поскольку услуги предоставляются онлайн, в том числе в видеозаписи и через Zoom, учитель YogaJoy не может лично и постоянно контролировать технику, физическое состояние, безопасность пространства и индивидуальные ограничения каждого пользователя.

Пользователь понимает, что просмотр материалов и возможное самостоятельное выполнение практик осуществляются добровольно. Пользователь самостоятельно принимает решение, выполнять ли демонстрируемые практики, в каком объёме и с каким уровнем нагрузки.

YogaJoy не даёт пользователю индивидуальной рекомендации выполнять конкретную практику. Пользователь несёт ответственность за своё состояние здоровья, выбор уровня нагрузки, безопасность пространства и соблюдение техники безопасности.

Практики YogaJoy могут использоваться как часть личной досуговой или оздоровительной рутины, но YogaJoy не гарантирует медицинский, лечебный, оздоровительный, психологический, физический или иной конкретный результат.

5. Рекомендация заниматься с инструктором

YogaJoy рекомендует пользователям, особенно начинающим, людям с ограничениями по здоровью, травмами, хроническими состояниями или беременностью, не ограничиваться самостоятельным просмотром видео.

Рекомендуется получить консультацию врача и, при необходимости, квалифицированного инструктора йоги или специалиста, который сможет лично наблюдать за пользователем, корректировать технику, контролировать нагрузку и учитывать индивидуальное состояние.

Видео, специальные практики и живые онлайн-занятия YogaJoy могут быть полезным вспомогательным инструментом, но они не заменяют индивидуальный контроль специалиста, если такой контроль необходим пользователю по состоянию здоровья или уровню подготовки.

6. Аккаунт пользователя

Для доступа к закрытым материалам пользователь должен создать аккаунт.

Пользователь отвечает за достоверность предоставленных данных, сохранность логина и пароля, все действия, совершённые через его аккаунт, и недопущение передачи доступа третьим лицам.

Запрещено передавать логин, пароль или доступ к аккаунту другим людям.

YogaJoy вправе ограничить или заблокировать доступ при нарушении условий, подозрении на передачу доступа, злоупотреблении бесплатным периодом или попытке обхода технических ограничений.

7. Бесплатный пробный доступ

Новый зарегистрированный пользователь может получить один бесплатный пробный доступ к разделу «Йога в записи» сроком на 30 дней.

Бесплатный доступ предоставляется один раз на пользователя, не подлежит обмену на деньги, не может быть передан другому лицу и может быть прекращён при злоупотреблении, создании повторных аккаунтов или нарушении условий Сервиса.

YogaJoy вправе изменять условия бесплатного пробного доступа для новых пользователей, публикуя актуальные условия на сайте.

8. Платные продукты и сроки доступа

YogaJoy может предлагать платные продукты, включая доступ к разделу «Йога в записи», доступ к просмотру живых онлайн-занятий, доступ к клубу, доступ к авторским программам, подарочные сертификаты и другие продукты, опубликованные на сайте.

Срок доступа указывается на странице продукта и/или при оформлении покупки.

Для разных продуктов могут использоваться разные сроки доступа, например 30, 90, 180 или 365 дней.

Доступ начинается после успешной оплаты, если для конкретного продукта не указано иное.

Если у пользователя уже есть активный доступ к тому же продукту, новый оплаченный срок может добавляться к текущему остатку дней.

9. Продукт «Йога»

Продукт «Йога» означает временный доступ к разделу платформы YogaJoy с видеозаписями йога-практик, дыхательных практик, медитаций, специальных практик и сопутствующих материалов.

Пользователь не покупает отдельные видеофайлы и не получает право собственности на материалы.

Пользователь получает личное, ограниченное, непередаваемое право онлайн-доступа к материалам раздела «Йога» на оплаченный срок.

В течение активного срока доступа пользователь может просматривать доступные видеоматериалы повторно и без ограничения количества просмотров через свой личный аккаунт.

Скачивание, копирование, запись экрана, распространение, передача доступа третьим лицам и коммерческое использование материалов запрещены.

Материалы раздела «Йога» являются информационно-развлекательным, информационным, досуговым и практическим контентом. Они не являются медицинской услугой, медицинской рекомендацией или индивидуальной консультацией.

10. Продукт «Живая йога»

Продукт «Живая йога» означает временный доступ к просмотру живых групповых онлайн-занятий йогой, проводимых через Zoom или другую онлайн-платформу.

Для доступа к живой йоге пользователь должен иметь активный доступ к соответствующему продукту, стабильное интернет-соединение, устройство для подключения, установленное приложение или доступ к выбранной онлайн-платформе, а также безопасное пространство для просмотра и, если пользователь самостоятельно принимает такое решение, для выполнения практик.

В рамках 30-дневного доступа к живой йоге YogaJoy предоставляет минимум 8 живых онлайн-занятий йогой в течение периода доступа.

Расписание занятий публикуется на сайте, в личном кабинете, по email или иным способом, выбранным YogaJoy.

YogaJoy вправе изменять расписание, переносить занятия, заменять инструктора или платформу проведения занятия, если это необходимо по организационным, техническим или иным причинам.

Если пользователь не смог подключиться к занятию по причинам, зависящим от пользователя, включая проблемы с интернетом, устройством, Zoom, временем подключения или личными обстоятельствами, занятие считается доступным пользователю и не создаёт автоматического права на возврат.

Если YogaJoy по своей причине не сможет предоставить минимум 8 живых занятий в течение 30-дневного периода доступа, YogaJoy предоставит пользователю разумную компенсацию, например перенос занятия, замену занятия, продление доступа или иной вариант по решению YogaJoy.

Во время живых онлайн-занятий инструктор не может гарантировать индивидуальный контроль техники и состояния каждого участника, особенно если участник не включает камеру, находится вне поля зрения, занимается в неподходящих условиях или имеет индивидуальные ограничения по здоровью.

Пользователь просматривает живые занятия добровольно и самостоятельно решает, выполнять ли демонстрируемые практики. Пользователь несёт ответственность за своё состояние здоровья, безопасность пространства и выбор уровня нагрузки.

11. Авторские программы

Авторские программы YogaJoy предоставляются в виде временного онлайн-доступа к определённой программе, видеоматериалам, аудиоматериалам, текстам, заданиям или иным материалам, указанным на странице программы.

Пользователь получает личное, ограниченное, непередаваемое право доступа к материалам авторской программы на указанный срок или на условиях, опубликованных на странице продукта.

Авторские программы являются информационно-развлекательным, информационным, досуговым и практическим контентом и не являются медицинской, лечебной, диагностической или индивидуальной консультационной услугой.

12. Клуб

Доступ к клубу может включать просмотр живых онлайн-встреч, доступ к клубным материалам, записям, вопросам-ответам, лекциям, обсуждениям и другим материалам, указанным на странице продукта.

Точный состав клубного доступа, расписание встреч и срок доступа публикуются на сайте.

YogaJoy вправе изменять темы встреч, расписание, формат и состав материалов клуба.

13. Подарочные сертификаты

YogaJoy может предлагать подарочные сертификаты.

Подарочный сертификат создаётся только после успешной оплаты, привязан к конкретному продукту и сроку доступа, содержит уникальный код, может быть активирован получателем в личном кабинете, не является денежным балансом, не подлежит обмену на деньги и не может быть использован повторно.

Срок доступа по сертификату начинается с момента активации сертификата получателем, если для конкретного сертификата не указано иное.

Если у получателя уже есть активный доступ к тому же продукту, срок по сертификату может добавляться к текущему остатку дней.

При возврате оплаты или отмене покупки сертификат может быть аннулирован.

14. Цены, оплата и налоги

Актуальные цены и валюта публикуются на сайте и отображаются пользователю до оформления заказа.

Оплата производится банковской картой или другим доступным способом через платёжного провайдера Stripe.

YogaJoy не хранит полные данные банковских карт пользователей. Обработка платёжных данных осуществляется Stripe в соответствии с его правилами безопасности.

Цена, валюта, срок доступа и основной состав продукта отображаются перед оплатой.

Если на странице конкретного продукта прямо не указано иное, все платежи являются разовыми. Автоматическое продление доступа и автоматические повторные списания не применяются.

Нажимая кнопку оплаты, пользователь подтверждает, что оформляет заказ с обязательством оплаты.

Название продукта в платёжном подтверждении Stripe может отличаться от короткого названия на сайте и может содержать уточнение о виде продукта, сроке доступа, названии авторской программы, живой онлайн-услуге или ином приобретаемом доступе.

Налоги, применимые к покупке, рассчитываются и отображаются в соответствии с применимым законодательством, местом нахождения покупателя, характером продукта и налоговым режимом YogaJoy.

15. Цифровой контент, начало предоставления услуг и право на отказ

15.1. Общее правило

Потребитель вправе отказаться от дистанционного договора в течение 14 календарных дней с даты его заключения, кроме случаев, когда право на отказ не применяется, ограничено или утрачено в соответствии с обязательным законодательством.

15.2. Цифровой контент в записи

К цифровому контенту относятся, в частности, продукт «Йога в записи», записанные авторские программы, видеоматериалы, аудиоматериалы, тексты и иные материалы, предоставляемые онлайн без материального носителя.

Доступ к цифровому контенту может начинаться сразу после успешной оплаты.

До предоставления немедленного доступа пользователь должен отдельно, посредством заранее не отмеченного чекбокса:

дать прямое согласие на начало предоставления цифрового контента до окончания 14-дневного срока отказа;

подтвердить, что понимает: после начала предоставления цифрового контента он утрачивает право на отказ в случаях, предусмотренных законом.

Текст отдельного чекбокса:

«Я прямо соглашаюсь, чтобы доступ к цифровому контенту начался сразу после оплаты, до окончания 14-дневного срока отказа, и подтверждаю, что понимаю: после начала предоставления цифрового контента я утрачиваю право на отказ в случаях, предусмотренных законом».

Если указанные согласие и подтверждение получены надлежащим образом и доступ фактически предоставлен, право на отказ от покупки цифрового контента может быть утрачено в соответствии с законом.

15.3. Живые онлайн-услуги и Клуб YogaJoy

К услугам относятся, в частности, продукт «Живая йога» и живые онлайн-встречи Клуба YogaJoy через Zoom или другую онлайн-платформу.

Если пользователь желает, чтобы предоставление такой услуги началось до окончания 14-дневного срока отказа, он должен отдельно и прямо попросить о начале предоставления услуги в этот период и подтвердить, что понимает: после полного исполнения услуги право на отказ может быть утрачено.

Текст отдельного чекбокса:

«Я прямо прошу начать предоставление услуги сразу после оплаты, до окончания 14-дневного срока отказа, и понимаю, что при отказе после начала предоставления услуги с меня может быть удержана пропорциональная стоимость уже предоставленной части услуги, а после полного исполнения услуги право на отказ может быть утрачено».

Если пользователь законно отказывается от услуги после её начала, но до полного исполнения, YogaJoy вправе удержать пропорциональную стоимость уже предоставленной части услуги в пределах, допускаемых законом.

15.4. Подтверждение покупки

После заключения договора YogaJoy предоставляет пользователю подтверждение покупки на долговременном носителе, например по email или в доступном для сохранения электронном виде. Подтверждение должно включать сведения о приобретённом продукте, цене, сроке доступа и, когда применимо, подтверждение прямого согласия на немедленное начало предоставления и понимания последствий для права на отказ.

16. Возвраты, отмена и рассмотрение претензий

16.1. Общие правила

Настоящий раздел применяется вместе с обязательными правами потребителя, которые не могут быть ограничены договором.

Для запроса возврата, реализации права на отказ, отмены или рассмотрения спорной ситуации пользователь должен написать на:

В обращении желательно указать:

имя и фамилию;

email аккаунта YogaJoy;

приобретённый продукт;

дату и сумму платежа;

причину обращения;

при наличии — подтверждение платежа Stripe.

16.2. Продукт «Йога в записи» и авторские программы

Продукт «Йога в записи» предоставляет временный онлайн-доступ к записанным видеоматериалам, йога-практикам, дыхательным практикам, медитациям, специальным практикам и сопутствующим материалам.

Авторские программы предоставляют временный онлайн-доступ к определённой записанной программе и относящимся к ней видео-, аудио- и текстовым материалам.

Если пользователь надлежащим образом дал прямое согласие на немедленное начало предоставления цифрового контента, подтвердил понимание утраты права на отказ и доступ фактически был предоставлен, возврат по причине обычного отказа от покупки после начала доступа не производится, если право на отказ было законно утрачено.

Это не ограничивает право пользователя требовать возврат, исправление или иное предусмотренное законом средство защиты, в частности если:

сумма была ошибочно списана дважды;

доступ не был предоставлен по причине, зависящей от YogaJoy;

цифровой контент имеет существенный технический недостаток, который YogaJoy не устранил в разумный срок;

предоставленный продукт существенно не соответствует описанию;

возврат или иное средство защиты обязательно в соответствии с применимым законодательством.

16.3. Продукт «Живая йога»

Продукт «Живая йога» предоставляет временный доступ к просмотру живых групповых онлайн-занятий через Zoom или другую онлайн-платформу.

Если пользователь прямо попросил начать предоставление услуги до окончания 14-дневного срока отказа, а затем законно отказался от договора в течение этого срока, YogaJoy вправе удержать пропорциональную стоимость части услуги, уже предоставленной до получения уведомления об отказе.

При расчёте могут учитываться истекшая часть срока доступа и уже проведённые живые занятия в соотношении с полным объёмом приобретённой услуги.

Если занятие состоялось, но пользователь не подключился по причинам, зависящим от пользователя, включая личные обстоятельства, ошибку во времени, проблемы с интернетом, устройством, приложением Zoom или иной используемой платформой, это не создаёт автоматического права на возврат за такое занятие.

Если YogaJoy отменяет занятие, пользователю предлагается один из разумных вариантов:

перенос занятия;

заменяющее занятие;

продление срока доступа;

пропорциональный возврат за непредоставленную часть услуги, если перенос, замена или продление невозможны.

Если YogaJoy не предоставляет предусмотренный минимум 8 живых занятий в течение 30-дневного периода доступа и не предлагает разумную замену или продление, пользователь вправе запросить пропорциональный возврат за непредоставленную часть услуги.

Если оплаченная услуга не была предоставлена вообще по причине, зависящей от YogaJoy, пользователь вправе потребовать полный возврат.

16.4. Продукт «Клуб YogaJoy»

Продукт «Клуб YogaJoy» предоставляет временный доступ к живым клубным онлайн-встречам через Zoom или другую онлайн-платформу, вопросам и ответам, клубным материалам, записям и иным материалам, указанным на странице продукта.

Если пользователь не подключился к запланированной клубной встрече по собственной причине, это не создаёт автоматического права на возврат.

Если YogaJoy отменяет клубную встречу, пользователю может быть предложена новая дата, заменяющая встреча, продление срока доступа либо пропорциональный возврат за непредоставленную часть услуги, если замена или продление невозможны.

Если в течение оплаченного срока YogaJoy фактически не предоставляет предусмотренную клубную услугу, пользователь вправе потребовать возврат за непредоставленную часть, а если услуга не была предоставлена полностью — полный возврат.

16.5. Подарочные сертификаты

Подарочный сертификат не является денежным балансом и привязан к конкретному продукту и сроку доступа.

В качестве договорной политики YogaJoy покупатель может в течение 14 календарных дней с даты покупки запросить отмену и возврат по неактивированному и неиспользованному сертификату. При одобрении возврата сертификат и его уникальный код аннулируются.

После активации сертификата применяются правила возврата продукта, к которому он относится.

Это положение не ограничивает и не расширяет обязательные права потребителя, определяемые применимым законодательством.

16.6. Порядок и сроки возврата

Одобренный возврат производится через Stripe на тот же способ оплаты, который использовался при покупке, если иной способ прямо не согласован с пользователем и не требуется законом.

При реализации законного права на отказ YogaJoy осуществляет возврат без необоснованной задержки и не позднее 14 календарных дней после получения уведомления об отказе, с учётом допускаемого законом удержания пропорциональной стоимости уже предоставленной части услуги.

После того как YogaJoy инициировал возврат, срок фактического зачисления денег зависит от Stripe, банка и платёжной системы пользователя.

16.7. Претензии и спорные платежи

YogaJoy рекомендует до обращения в банк с оспариванием платежа сначала связаться с нами по адресу:

Мы постараемся рассмотреть обращение и предоставить ответ в течение 10 рабочих дней.

Предварительное обращение в YogaJoy не является обязательным и не ограничивает право пользователя обратиться в банк, Stripe, органы защиты прав потребителей, суд или другие компетентные органы.

Ничто в настоящем разделе не ограничивает обязательные права потребителя, которые не могут быть ограничены договором.

17. Интеллектуальные права

Все материалы YogaJoy, включая видео, аудио, тексты, изображения, дизайн, логотипы, названия, программы, последовательности практик и другие элементы, защищены авторским правом и иными правами интеллектуальной собственности.

Пользователю предоставляется личное, ограниченное, непередаваемое право доступа к материалам только для личного некоммерческого использования.

Запрещено без письменного разрешения YogaJoy копировать материалы, скачивать видео или аудио, если такая функция прямо не предусмотрена, записывать экран, распространять материалы, публиковать материалы в интернете, передавать доступ третьим лицам, использовать материалы в коммерческих целях, проводить по материалам свои занятия, курсы или программы, создавать производные продукты на основе материалов YogaJoy.

18. Запрещённое использование

Пользователю запрещено взламывать сайт или пытаться получить несанкционированный доступ, обходить технические ограничения, использовать чужой аккаунт, передавать аккаунт третьим лицам, копировать или распространять закрытый контент, использовать Сервис для незаконных целей, размещать незаконный, оскорбительный, вредоносный или чужой контент, совершать действия, которые могут нарушить работу сайта, сервера, платёжной системы или аккаунтов других пользователей.

19. Техническая доступность

YogaJoy стремится обеспечивать стабильную работу Сервиса, но не гарантирует непрерывную и безошибочную доступность сайта, видео, личного кабинета, Zoom-занятий, платёжной системы или иных технических элементов.

Возможны технические перерывы, обновления, ошибки, ограничения доступа, сбои связи, проблемы на стороне пользователя, провайдеров, Stripe, Zoom, хостинга или иных третьих лиц.

YogaJoy не несёт ответственности за невозможность доступа, вызванную устройством пользователя, интернет-соединением, настройками браузера, блокировками, сбоями сторонних сервисов или неправильным использованием платформы.

20. Обращения, жалобы и поддержка

По вопросам, обращениям и жалобам пользователь может написать на email:

YogaJoy рассмотрит обращение и ответит в разумный срок или в срок, предусмотренный применимым законодательством.

Если пользователь является потребителем и спор не был урегулирован напрямую, он может обратиться в компетентные органы защиты прав потребителей.

21. Конфиденциальность и персональные данные

Обработка персональных данных описана в отдельной Политике конфиденциальности.

При регистрации пользователь подтверждает, что ознакомлен с Политикой конфиденциальности.

Согласие на получение новостей, рассылок и маркетинговых сообщений должно даваться отдельно и не является обязательным условием использования Сервиса, если иное не предусмотрено законом.

22. Cookies

Использование cookies и аналогичных технологий описано в отдельной Политике cookies.

23. Отказ от гарантий

Сервис предоставляется «как есть» и «как доступно» в пределах, допустимых законом.

YogaJoy не гарантирует достижение конкретного физического, психологического, оздоровительного или иного результата, улучшение здоровья, отсутствие дискомфорта, отсутствие технических ошибок, постоянную доступность всех материалов, совместимость Сервиса со всеми устройствами и браузерами.

Это не ограничивает обязательные права потребителя, включая права, которые не могут быть ограничены по закону.

24. Ограничение ответственности

В пределах, допустимых законом, YogaJoy не несёт ответственности за травмы, ухудшение самочувствия или вред здоровью при самостоятельном выполнении практик, неверный выбор пользователем уровня нагрузки, игнорирование медицинских противопоказаний, нарушение пользователем техники безопасности, отсутствие индивидуального контроля со стороны инструктора, технические сбои на стороне пользователя или третьих сервисов, действия платёжных систем, интернет-провайдеров, Zoom, хостинга и иных третьих лиц, косвенные убытки, упущенную выгоду или невозможность использовать Сервис по причинам вне контроля YogaJoy.

Ничто в настоящем соглашении не ограничивает ответственность, которая не может быть ограничена по закону.

25. Изменение условий

YogaJoy вправе обновлять настоящее Пользовательское соглашение, функциональность сайта, состав продуктов, цены, расписание, правила доступа и иные условия.

Актуальная версия соглашения публикуется на сайте с датой вступления в силу.

Продолжение использования Сервиса после публикации обновлённой версии означает принятие обновлённых условий, если иное не требуется применимым законодательством.

26. Приостановление или прекращение доступа

YogaJoy вправе временно ограничить, приостановить или прекратить доступ пользователя к Сервису при нарушении настоящих условий, передаче доступа третьим лицам, попытке копирования или распространения материалов, злоупотреблении бесплатным доступом, мошеннических действиях, нарушении правил оплаты, действиях, угрожающих работе Сервиса или правам других пользователей.

27. Языковые версии

Настоящие условия могут быть доступны на русском, испанском, английском или других языках.

Основной юридической версией является испанская версия.

В случае расхождений между языковыми версиями преимущественную силу имеет испанская версия, если иное не предусмотрено обязательными нормами защиты потребителей.

28. Применимое право и споры

Настоящее соглашение регулируется законодательством Испании и применимым правом Европейского Союза.

Если пользователь является потребителем, применяются обязательные нормы защиты потребителей и правила юрисдикции, которые не могут быть ограничены договором.

Если пользователь действует как предприниматель, профессионал или организация, споры подлежат рассмотрению в компетентных судах Испании по месту нахождения владельца Сервиса, если иное не предусмотрено обязательным законом.

Los presentes Términos de uso regulan el uso de la plataforma online YogaJoy, disponible en yogajoy.space.

1. Aceptación de los términos

Al utilizar el sitio web, crear una cuenta, recibir acceso gratuito, comprar acceso, activar un certificado o visualizar materiales de la plataforma, el usuario confirma que ha leído, entendido y acepta los presentes Términos de uso.

Si el usuario no está de acuerdo con estos términos, no debe utilizar el Servicio.

La aceptación de los términos se realiza de forma electrónica mediante una casilla de aceptación al registrarse, comprar, activar el acceso o utilizar el Servicio.

2. Edad del usuario

El Servicio está destinado únicamente a usuarios mayores de 18 años.

Al crear una cuenta, el usuario confirma que tiene 18 años o más.

3. Naturaleza del Servicio

YogaJoy es una plataforma online que proporciona al usuario acceso temporal online a contenido digital y materiales alojados en la plataforma.

YogaJoy no vende archivos de vídeo individuales, productos físicos ni clases individuales.

Según el producto elegido, el acceso puede incluir la visualización de vídeos grabados de yoga, prácticas de respiración, meditaciones, prácticas especiales y otros materiales, la visualización de clases online en directo a través de Zoom u otra plataforma online, el acceso a materiales de vídeo, programas de autor, materiales del club, certificados regalo y otros materiales indicados en la página del producto.

Salvo que se indique otra cosa para un producto concreto, el usuario puede visualizar los materiales de vídeo disponibles de forma repetida y sin límite de visualizaciones durante el periodo activo de acceso.

La visualización repetida solo está permitida a través de la cuenta personal del usuario en la plataforma YogaJoy.

Está prohibido descargar, copiar, grabar la pantalla, distribuir, transferir el acceso a terceros y cualquier uso comercial de los materiales.

Los materiales de YogaJoy son contenido informativo-recreativo, informativo, de ocio y práctico. No constituyen servicio médico, recomendación médica, diagnóstico, tratamiento, rehabilitación, fisioterapia, consulta individual ni acompañamiento personal del usuario.

4. Aviso importante sobre salud y seguridad

El contenido de YogaJoy tiene carácter informativo-recreativo, informativo, de ocio y práctico.

YogaJoy no presta servicios médicos, diagnósticos, terapéuticos, de rehabilitación ni de fisioterapia.

Las prácticas mostradas en la plataforma no constituyen consejo médico, no sustituyen la consulta con un médico y no son un programa educativo oficial con obtención de una cualificación profesional.

El yoga, las técnicas de respiración, las meditaciones y otras prácticas pueden implicar esfuerzo físico y riesgo de lesión, empeoramiento del bienestar o agravamiento de condiciones existentes.

Antes de visualizar los materiales y antes de realizar por su cuenta cualquier práctica, el usuario debe valorar de forma independiente su estado de salud.

YogaJoy recomienda encarecidamente consultar con un médico antes de comenzar cualquier práctica, especialmente en caso de lesiones, enfermedades, embarazo, enfermedades crónicas, operaciones, problemas cardíacos, presión arterial, columna vertebral, articulaciones, sistema respiratorio u otras limitaciones.

Siempre que sea posible, YogaJoy recomienda practicar bajo la supervisión de un instructor cualificado que pueda controlar personalmente la técnica, el nivel de carga, la posición del cuerpo y el estado del usuario.

El usuario debe elegir únicamente materiales y prácticas adecuados a su propio nivel de preparación y estado de salud, realizar cualquier movimiento con cuidado, sin dolor y sin forzar el cuerpo, y detener inmediatamente la práctica en caso de dolor, mareo, náuseas, debilidad, dificultad para respirar, empeoramiento del estado físico o cualquier molestia.

Dado que los servicios se prestan online, tanto mediante vídeos grabados como a través de Zoom, el profesor de YogaJoy no puede controlar personal y constantemente la técnica, el estado físico, la seguridad del espacio ni las limitaciones individuales de cada usuario.

El usuario entiende que la visualización de los materiales y la posible realización independiente de las prácticas se efectúan de forma voluntaria. El usuario decide de forma independiente si realiza las prácticas demostradas, en qué medida y con qué nivel de carga.

YogaJoy no proporciona al usuario una recomendación individual de realizar una práctica concreta. El usuario es responsable de su estado de salud, de la elección del nivel de carga, de la seguridad del espacio y del cumplimiento de las normas de seguridad.

Las prácticas de YogaJoy pueden utilizarse como parte de una rutina personal de ocio o bienestar, pero YogaJoy no garantiza ningún resultado médico, terapéutico, de salud, psicológico, físico o de otro tipo.

5. Recomendación de practicar con instructor

YogaJoy recomienda a los usuarios, especialmente a principiantes, personas con limitaciones de salud, lesiones, condiciones crónicas o embarazo, no limitarse únicamente a la visualización independiente de vídeos.

Se recomienda recibir la consulta de un médico y, si es necesario, de un instructor de yoga cualificado o especialista que pueda observar personalmente al usuario, corregir la técnica, controlar la carga y tener en cuenta su estado individual.

Los vídeos, prácticas especiales y clases online en directo de YogaJoy pueden ser una herramienta de apoyo útil, pero no sustituyen el control individual de un especialista cuando dicho control sea necesario por el estado de salud o el nivel de preparación del usuario.

6. Cuenta de usuario

Para acceder a los materiales cerrados, el usuario debe crear una cuenta.

El usuario es responsable de la veracidad de los datos proporcionados, de la seguridad de su nombre de usuario y contraseña, de todas las acciones realizadas desde su cuenta y de no transferir el acceso a terceros.

Está prohibido compartir el nombre de usuario, la contraseña o el acceso a la cuenta con otras personas.

YogaJoy podrá limitar o bloquear el acceso en caso de incumplimiento de estos términos, sospecha de cesión de acceso, abuso del periodo gratuito o intento de eludir restricciones técnicas.

7. Acceso gratuito de prueba

Un nuevo usuario registrado puede recibir un acceso gratuito de prueba a la sección “Yoga grabado” por un periodo de 30 días.

El acceso gratuito se concede una sola vez por usuario, no puede cambiarse por dinero, no puede transferirse a otra persona y puede ser cancelado en caso de abuso, creación de cuentas repetidas o incumplimiento de los términos del Servicio.

YogaJoy podrá modificar las condiciones del acceso gratuito de prueba para nuevos usuarios, publicando las condiciones actualizadas en el sitio web.

8. Productos de pago y plazos de acceso

YogaJoy puede ofrecer productos de pago, incluyendo acceso a la sección “Yoga grabado”, acceso a la visualización de clases online en directo, acceso al club, acceso a programas de autor, certificados regalo y otros productos publicados en el sitio web.

El plazo de acceso se indica en la página del producto y/o durante el proceso de compra.

Para distintos productos pueden aplicarse distintos plazos de acceso, por ejemplo 30, 90, 180 o 365 días.

El acceso comienza después del pago realizado con éxito, salvo que se indique otra cosa para un producto concreto.

Si el usuario ya tiene acceso activo al mismo producto, el nuevo periodo pagado puede añadirse a los días restantes del acceso actual.

9. Producto “Yoga”

El producto “Yoga” significa acceso temporal a la sección de la plataforma YogaJoy con vídeos grabados de prácticas de yoga, prácticas de respiración, meditaciones, prácticas especiales y materiales relacionados.

El usuario no compra archivos de vídeo individuales ni adquiere derechos de propiedad sobre los materiales.

El usuario recibe un derecho personal, limitado e intransferible de acceso online a los materiales de la sección “Yoga” durante el periodo pagado.

Durante el periodo activo de acceso, el usuario puede visualizar los materiales de vídeo disponibles de forma repetida y sin límite de visualizaciones a través de su cuenta personal.

Está prohibido descargar, copiar, grabar la pantalla, distribuir, transferir el acceso a terceros y utilizar comercialmente los materiales.

Los materiales de la sección “Yoga” son contenido informativo-recreativo, informativo, de ocio y práctico. No constituyen servicio médico, recomendación médica ni consulta individual.

10. Producto “Yoga en directo”

El producto “Yoga en directo” significa acceso temporal a la visualización de clases grupales online de yoga en directo, realizadas a través de Zoom u otra plataforma online.

Para acceder al yoga en directo, el usuario debe tener acceso activo al producto correspondiente, conexión estable a internet, dispositivo adecuado para conectarse, aplicación instalada o acceso a la plataforma online elegida, y espacio seguro para visualizar y, si el usuario toma esa decisión por su cuenta, para realizar las prácticas.

Dentro de un acceso de 30 días al yoga en directo, YogaJoy proporciona un mínimo de 8 clases online en directo de yoga durante el periodo de acceso.

El horario de las clases se publica en el sitio web, en la cuenta personal, por email o por otro medio elegido por YogaJoy.

YogaJoy podrá modificar el horario, reprogramar clases, sustituir al instructor o cambiar la plataforma de la clase cuando sea necesario por razones organizativas, técnicas u otras.

Si el usuario no puede conectarse a una clase por causas dependientes del usuario, incluyendo problemas de internet, dispositivo, Zoom, hora de conexión o circunstancias personales, la clase se considera disponible para el usuario y no genera automáticamente derecho a reembolso.

Si YogaJoy, por causa propia, no puede proporcionar el mínimo de 8 clases en directo durante el periodo de acceso de 30 días, YogaJoy ofrecerá al usuario una compensación razonable, por ejemplo una reprogramación, una clase sustitutiva, una extensión del acceso u otra opción a criterio de YogaJoy.

Durante las clases online en directo, el instructor no puede garantizar el control individual de la técnica y del estado de cada participante, especialmente si el participante no enciende la cámara, está fuera del campo de visión, practica en condiciones inadecuadas o tiene limitaciones individuales de salud.

El usuario visualiza las clases en directo voluntariamente y decide de forma independiente si realiza las prácticas demostradas. El usuario es responsable de su estado de salud, de la seguridad del espacio y de la elección del nivel de carga.

11. Programas de autor

Los programas de autor de YogaJoy se proporcionan como acceso temporal online a un programa determinado, materiales de vídeo, materiales de audio, textos, tareas u otros materiales indicados en la página del programa.

El usuario recibe un derecho personal, limitado e intransferible de acceso a los materiales del programa de autor durante el periodo indicado o en las condiciones publicadas en la página del producto.

Los programas de autor son contenido informativo-recreativo, informativo, de ocio y práctico y no constituyen servicio médico, terapéutico, diagnóstico ni consulta individual.

12. Club

El acceso al club puede incluir la visualización de encuentros online en directo, acceso a materiales del club, grabaciones, preguntas y respuestas, conferencias, debates y otros materiales indicados en la página del producto.

El contenido exacto del acceso al club, el calendario de encuentros y el plazo de acceso se publican en el sitio web.

YogaJoy podrá modificar los temas de los encuentros, el horario, el formato y el contenido de los materiales del club.

13. Certificados regalo

YogaJoy puede ofrecer certificados regalo.

El certificado regalo se genera solo después de un pago realizado con éxito, está vinculado a un producto concreto y a un plazo de acceso concreto, contiene un código único, puede ser activado por el destinatario en su cuenta personal, no constituye un saldo monetario, no puede cambiarse por dinero y no puede utilizarse más de una vez.

El plazo de acceso del certificado comienza desde el momento de la activación por el destinatario, salvo que se indique otra cosa para un certificado concreto.

Si el destinatario ya tiene acceso activo al mismo producto, el plazo del certificado puede añadirse a los días restantes del acceso actual.

En caso de reembolso o cancelación de la compra, el certificado puede ser anulado.

14. Precios, pago e impuestos

Los precios y la moneda vigentes se publican en el sitio web y se muestran al usuario antes de realizar el pedido.

El pago se realiza mediante tarjeta bancaria u otro método disponible a través del proveedor de pagos Stripe.

YogaJoy no almacena los datos completos de las tarjetas bancarias de los usuarios. El tratamiento de los datos de pago lo realiza Stripe conforme a sus normas de seguridad.

El precio, la moneda, el periodo de acceso y el contenido principal del producto se muestran antes del pago.

Salvo que se indique expresamente otra cosa en la página del producto correspondiente, todos los pagos son únicos. No se aplican renovaciones automáticas del acceso ni cargos recurrentes automáticos.

Al pulsar el botón de pago, el usuario confirma que realiza un pedido con obligación de pago.

El nombre del producto en la confirmación de pago de Stripe puede diferir del nombre abreviado mostrado en el sitio web y puede incluir una aclaración sobre el tipo de producto, el periodo de acceso, el nombre del programa de autor, el servicio online en directo u otro acceso adquirido.

Los impuestos aplicables a la compra se calculan y muestran conforme a la legislación aplicable, la ubicación del comprador, la naturaleza del producto y el régimen fiscal de YogaJoy.

15. Contenido digital, inicio de los servicios y derecho de desistimiento

15.1. Regla general

El consumidor podrá desistir de un contrato a distancia dentro de los 14 días naturales siguientes a su celebración, salvo cuando el derecho de desistimiento no sea aplicable, esté limitado o se haya perdido conforme a la legislación imperativa aplicable.

15.2. Contenido digital grabado

Se considera contenido digital, entre otros, el producto «Yoga grabado», los programas de autor grabados, vídeos, audios, textos y otros materiales suministrados online sin soporte material.

El acceso al contenido digital puede comenzar inmediatamente después del pago realizado con éxito.

Antes de recibir acceso inmediato, el usuario deberá, mediante una casilla separada no marcada previamente:

prestar su consentimiento expreso para que el suministro del contenido digital comience antes de que finalice el plazo de desistimiento de 14 días;

confirmar que comprende que, una vez iniciado el suministro del contenido digital, pierde el derecho de desistimiento en los casos previstos por la ley.

La casilla separada contendrá el siguiente texto:

«Consiento expresamente que el acceso al contenido digital comience inmediatamente después del pago, antes de que finalice el plazo de desistimiento de 14 días, y confirmo que entiendo que, una vez iniciado el suministro del contenido digital, pierdo mi derecho de desistimiento en los casos previstos por la ley».

Cuando dicho consentimiento y confirmación se hayan obtenido correctamente y el acceso se haya proporcionado efectivamente, el derecho de desistimiento respecto del contenido digital podrá perderse conforme a la ley.

15.3. Servicios online en directo y Club YogaJoy

Se consideran servicios, entre otros, el producto «Yoga en directo» y los encuentros online en directo del Club YogaJoy a través de Zoom u otra plataforma online.

Si el usuario desea que la prestación del servicio comience antes de que finalice el plazo de desistimiento de 14 días, deberá solicitarlo de forma separada y expresa y confirmar que comprende que, una vez que el servicio haya sido ejecutado íntegramente, podrá perder el derecho de desistimiento.

La casilla separada contendrá el siguiente texto:

«Solicito expresamente que la prestación del servicio comience inmediatamente después del pago, antes de que finalice el plazo de desistimiento de 14 días, y entiendo que, si desisto después de que haya comenzado el servicio, podrá descontarse el importe proporcional de la parte ya prestada y que, una vez ejecutado íntegramente el servicio, podré perder el derecho de desistimiento».

Si el usuario desiste válidamente del servicio después de su inicio, pero antes de su ejecución completa, YogaJoy podrá retener el importe proporcional correspondiente a la parte ya prestada, en la medida permitida por la ley.

15.4. Confirmación de la compra

Después de la celebración del contrato, YogaJoy proporciona al usuario una confirmación de la compra en un soporte duradero, por ejemplo por email o en un formato electrónico que pueda conservarse. La confirmación deberá incluir información sobre el producto adquirido, el precio, el periodo de acceso y, cuando proceda, la confirmación del consentimiento expreso para el inicio inmediato y del conocimiento de sus consecuencias para el derecho de desistimiento.

16. Reembolsos, cancelaciones y reclamaciones

16.1. Normas generales

La presente sección se aplica sin perjuicio de los derechos imperativos del consumidor que no puedan limitarse contractualmente.

Para solicitar un reembolso, ejercer el derecho de desistimiento, cancelar o pedir la revisión de una situación controvertida, el usuario deberá escribir a:

Es recomendable incluir:

nombre y apellidos;

email asociado a la cuenta de YogaJoy;

producto adquirido;

fecha e importe del pago;

motivo de la solicitud;

cuando esté disponible, confirmación del pago de Stripe.

16.2. Producto «Yoga grabado» y programas de autor

El producto «Yoga grabado» proporciona acceso temporal online a vídeos grabados, prácticas de yoga, prácticas de respiración, meditaciones, prácticas especiales y materiales relacionados.

Los programas de autor proporcionan acceso temporal online a un programa grabado específico y a sus materiales de vídeo, audio y texto relacionados.

Cuando el usuario haya prestado correctamente su consentimiento expreso al inicio inmediato del suministro del contenido digital, haya confirmado que comprende la pérdida del derecho de desistimiento y el acceso se haya proporcionado efectivamente, no se efectuará un reembolso por un simple cambio de opinión después del inicio del acceso si el derecho de desistimiento se ha perdido legalmente.

Esto no limita el derecho del usuario a solicitar un reembolso, subsanación u otro remedio previsto por la ley, en particular cuando:

se haya realizado por error un cargo duplicado;

el acceso no haya sido proporcionado por una causa imputable a YogaJoy;

el contenido digital presente un defecto técnico sustancial que YogaJoy no haya corregido en un plazo razonable;

el producto suministrado no se corresponda sustancialmente con su descripción;

el reembolso u otro remedio sea obligatorio conforme a la legislación aplicable.

16.3. Producto «Yoga en directo»

El producto «Yoga en directo» proporciona acceso temporal a la visualización de clases grupales online en directo a través de Zoom u otra plataforma online.

Si el usuario ha solicitado expresamente que la prestación del servicio comience antes de que finalice el plazo de desistimiento de 14 días y posteriormente desiste válidamente del contrato dentro de dicho plazo, YogaJoy podrá retener el importe proporcional de la parte del servicio ya prestada hasta la recepción de la comunicación de desistimiento.

Para calcular dicho importe podrán tenerse en cuenta la parte transcurrida del periodo de acceso y las clases en directo ya celebradas, en relación con el volumen total del servicio adquirido.

Si una clase se ha celebrado y el usuario no se ha conectado por causas imputables al usuario, incluidas circunstancias personales, error en la hora, problemas de internet, dispositivo, aplicación Zoom u otra plataforma utilizada, ello no genera automáticamente derecho al reembolso de dicha clase.

Si YogaJoy cancela una clase, se ofrecerá al usuario una opción razonable entre:

reprogramación de la clase;

clase sustitutiva;

ampliación del periodo de acceso;

reembolso proporcional de la parte no prestada del servicio, cuando la reprogramación, sustitución o ampliación no sean posibles.

Si YogaJoy no proporciona el mínimo previsto de 8 clases en directo durante un periodo de acceso de 30 días y no ofrece una sustitución o ampliación razonable, el usuario podrá solicitar un reembolso proporcional por la parte no prestada del servicio.

Si el servicio pagado no se ha prestado en absoluto por una causa imputable a YogaJoy, el usuario podrá solicitar un reembolso completo.

16.4. Producto «Club YogaJoy»

El producto «Club YogaJoy» proporciona acceso temporal a encuentros online del club en directo a través de Zoom u otra plataforma online, sesiones de preguntas y respuestas, materiales del club, grabaciones y otros contenidos indicados en la página del producto.

Si el usuario no se conecta a un encuentro programado por una causa propia, ello no genera automáticamente derecho a reembolso.

Si YogaJoy cancela un encuentro del club, podrá ofrecer al usuario una nueva fecha, un encuentro sustitutivo, una ampliación del periodo de acceso o un reembolso proporcional de la parte no prestada del servicio cuando la sustitución o ampliación no sean posibles.

Si durante el periodo pagado YogaJoy no proporciona efectivamente el servicio de club previsto, el usuario podrá solicitar el reembolso de la parte no prestada y, cuando el servicio no se haya prestado en absoluto, un reembolso completo.

16.5. Certificados regalo

El certificado regalo no constituye un saldo monetario y está vinculado a un producto concreto y a un periodo de acceso concreto.

Como política contractual de YogaJoy, el comprador podrá solicitar, dentro de los 14 días naturales siguientes a la compra, la cancelación y el reembolso de un certificado que no haya sido activado ni utilizado. Si se aprueba el reembolso, el certificado y su código único serán anulados.

Después de la activación se aplicarán las reglas de reembolso del producto al que esté vinculado el certificado.

Esta disposición no limita ni amplía los derechos imperativos del consumidor establecidos por la legislación aplicable.

16.6. Procedimiento y plazo del reembolso

Los reembolsos aprobados se efectuarán a través de Stripe utilizando el mismo método de pago empleado en la compra, salvo que se acuerde expresamente otro método con el usuario o que la ley exija otra cosa.

Cuando se ejerza válidamente el derecho legal de desistimiento, YogaJoy efectuará el reembolso sin demora indebida y, en todo caso, dentro de los 14 días naturales siguientes a la recepción de la comunicación de desistimiento, teniendo en cuenta la deducción legalmente permitida del importe proporcional correspondiente a la parte del servicio ya prestada.

Una vez que YogaJoy haya iniciado el reembolso, el plazo efectivo de abono dependerá de Stripe, del banco y del sistema de pago del usuario.

16.7. Reclamaciones y pagos controvertidos

YogaJoy recomienda que, antes de iniciar una disputa bancaria, el usuario contacte primero con nosotros en:

Intentaremos revisar la solicitud y responder dentro de un plazo de 10 días laborables.

El contacto previo con YogaJoy no es obligatorio y no limita el derecho del usuario a dirigirse a su banco, Stripe, las autoridades de protección de consumidores, los tribunales u otros organismos competentes.

Nada de lo dispuesto en esta sección limita los derechos imperativos del consumidor que no puedan restringirse contractualmente.

17. Propiedad intelectual

Todos los materiales de YogaJoy, incluyendo vídeos, audios, textos, imágenes, diseño, logotipos, nombres, programas, secuencias de prácticas y otros elementos, están protegidos por derechos de autor y otros derechos de propiedad intelectual.

El usuario recibe un derecho personal, limitado, no transferible, de acceso a los materiales únicamente para uso personal y no comercial.

Sin autorización escrita de YogaJoy, está prohibido copiar materiales, descargar vídeos o audios, salvo que dicha función esté expresamente prevista, grabar la pantalla, distribuir materiales, publicar materiales en internet, transferir el acceso a terceros, utilizar materiales con fines comerciales, impartir clases, cursos o programas propios basados en los materiales, crear productos derivados a partir de los materiales de YogaJoy.

18. Uso prohibido

El usuario tiene prohibido hackear el sitio o intentar obtener acceso no autorizado, eludir restricciones técnicas, utilizar la cuenta de otra persona, transferir la cuenta a terceros, copiar o distribuir contenido cerrado, utilizar el Servicio con fines ilegales, publicar contenido ilegal, ofensivo, dañino o ajeno, realizar acciones que puedan afectar al funcionamiento del sitio, servidor, sistema de pago o cuentas de otros usuarios.

19. Disponibilidad técnica

YogaJoy se esfuerza por garantizar un funcionamiento estable del Servicio, pero no garantiza la disponibilidad continua y sin errores del sitio web, vídeos, cuenta personal, clases de Zoom, sistema de pago u otros elementos técnicos.

Pueden producirse interrupciones técnicas, actualizaciones, errores, restricciones de acceso, fallos de conexión, problemas del lado del usuario, proveedores, Stripe, Zoom, hosting u otros terceros.

YogaJoy no se hace responsable de la imposibilidad de acceso causada por el dispositivo del usuario, conexión a internet, configuración del navegador, bloqueos, fallos de servicios de terceros o uso incorrecto de la plataforma.

20. Consultas, reclamaciones y soporte

Para consultas, solicitudes y reclamaciones, el usuario puede escribir al email:

YogaJoy revisará la solicitud y responderá en un plazo razonable o en el plazo previsto por la legislación aplicable.

Si el usuario es consumidor y la controversia no se resuelve directamente, podrá acudir a las autoridades competentes de protección de consumidores.

El tratamiento de datos personales se describe en la Política de Privacidad separada.

Al registrarse, el usuario confirma que ha sido informado de la Política de Privacidad.

El consentimiento para recibir noticias, boletines y comunicaciones comerciales debe darse por separado y no es una condición obligatoria para el uso del Servicio, salvo que la ley disponga otra cosa.

22. Cookies

El uso de cookies y tecnologías similares se describe en la Política de Cookies separada.

23. Exclusión de garantías

El Servicio se presta “tal cual” y “según disponibilidad”, en la medida permitida por la ley.

YogaJoy no garantiza la obtención de un resultado físico, psicológico, de bienestar o de otro tipo, la mejora de la salud, la ausencia de molestias, la ausencia de errores técnicos, la disponibilidad permanente de todos los materiales ni la compatibilidad del Servicio con todos los dispositivos y navegadores.

Esto no limita los derechos obligatorios del consumidor, incluidos aquellos derechos que no pueden limitarse por ley.

24. Limitación de responsabilidad

En la medida permitida por la ley, YogaJoy no será responsable por lesiones, empeoramiento del bienestar o daños a la salud durante la realización independiente de prácticas, elección incorrecta del nivel de carga por parte del usuario, ignorar contraindicaciones médicas, incumplimiento por parte del usuario de las normas de seguridad, ausencia de control individual por parte del instructor, fallos técnicos del lado del usuario o de servicios de terceros, acciones de sistemas de pago, proveedores de internet, Zoom, hosting y otros terceros, daños indirectos, lucro cesante o imposibilidad de usar el Servicio por causas fuera del control de YogaJoy.

Nada en estos términos limita la responsabilidad que no pueda ser limitada por ley.

25. Modificación de los términos

YogaJoy podrá actualizar los presentes Términos de uso, la funcionalidad del sitio, el contenido de los productos, los precios, el horario, las reglas de acceso y otras condiciones.

La versión vigente de los términos se publicará en el sitio web con la fecha de entrada en vigor.

La continuación del uso del Servicio después de la publicación de la versión actualizada significa la aceptación de las condiciones actualizadas, salvo que la legislación aplicable exija otra cosa.

26. Suspensión o terminación del acceso

YogaJoy podrá limitar, suspender o terminar temporalmente el acceso del usuario al Servicio en caso de incumplimiento de estos términos, transferencia del acceso a terceros, intento de copiar o distribuir materiales, abuso del acceso gratuito, acciones fraudulentas, incumplimiento de las reglas de pago, acciones que amenacen el funcionamiento del Servicio o los derechos de otros usuarios.

27. Versiones lingüísticas

Los presentes términos pueden estar disponibles en ruso, español, inglés u otros idiomas.

La versión jurídica principal es la versión española.

En caso de discrepancias entre las versiones lingüísticas, prevalecerá la versión española, salvo que normas imperativas de protección de consumidores dispongan otra cosa.

28. Ley aplicable y controversias

Los presentes términos se rigen por la legislación de España y por la normativa aplicable de la Unión Europea.

Si el usuario es consumidor, se aplicarán las normas imperativas de protección de consumidores y de jurisdicción que no puedan ser limitadas por contrato.

Si el usuario actúa como empresario, profesional u organización, las controversias serán sometidas a los tribunales competentes de España del lugar de establecimiento del titular del Servicio, salvo que una norma imperativa disponga otra cosa.

These Terms of Use govern the use of the online platform YogaJoy, available at yogajoy.space.

1. Acceptance of the Terms

By using the website, creating an account, receiving free access, purchasing access, activating a certificate or viewing platform materials, the user confirms that they have read, understood and accepted these Terms of Use.

If the user does not agree with these Terms, they must not use the Service.

Acceptance of the Terms is made electronically by ticking the relevant checkbox during registration, purchase, access activation or use of the Service.

2. User Age

The Service is intended only for users aged 18 or older.

By creating an account, the user confirms that they are at least 18 years old.

3. Nature of the Service

YogaJoy is an online platform that provides the user with temporary online access to digital content and materials hosted on the platform.

YogaJoy does not sell individual video files, physical products or individual classes.

Depending on the selected product, access may include viewing recorded yoga videos, breathing practices, meditations, special practices and other materials, viewing live online classes via Zoom or another online platform, access to video materials, author programs, club materials, gift certificates and other materials indicated on the product page.

Unless otherwise specified for a particular product, the user may view the available video materials repeatedly and without limitation on the number of views during the active access period.

Repeated viewing is permitted only through the user’s personal account on the YogaJoy platform.

Downloading, copying, screen recording, distribution, transfer of access to third parties and any commercial use of the materials are prohibited.

YogaJoy materials are informational-entertainment, informational, leisure and practical content. They do not constitute a medical service, medical recommendation, diagnosis, treatment, rehabilitation, physiotherapy, individual consultation or personal supervision of the user.

4. Important Health and Safety Notice

YogaJoy content is informational-entertainment, informational, leisure and practical in nature.

YogaJoy does not provide medical, diagnostic, therapeutic, rehabilitation or physiotherapy services.

The practices shown on the platform are not medical advice, do not replace consultation with a doctor and are not an official educational program leading to a professional qualification.

Yoga, breathing techniques, meditations and other practices may involve physical effort and the risk of injury, worsening of well-being or aggravation of existing conditions.

Before viewing the materials and before independently performing any practices, the user must independently assess their health condition.

YogaJoy strongly recommends consulting a doctor before starting any practices, especially in case of injuries, illnesses, pregnancy, chronic conditions, surgeries, heart problems, blood pressure issues, spine, joints, respiratory system problems or other limitations.

Whenever possible, YogaJoy recommends practicing under the supervision of a qualified instructor who can personally monitor technique, level of load, body position and the user’s condition.

The user must choose only materials and practices suitable for their level of preparation and health condition, perform any movements carefully, without pain and without forcing the body, and immediately stop the practice in case of pain, dizziness, nausea, weakness, difficulty breathing, worsening of condition or any discomfort.

Since the services are provided online, including recorded videos and Zoom classes, the YogaJoy teacher cannot personally and continuously monitor the technique, physical condition, safety of the space or individual limitations of each user.

The user understands that viewing the materials and any possible independent performance of the practices are voluntary. The user independently decides whether to perform the demonstrated practices, to what extent and with what level of load.

YogaJoy does not give the user an individual recommendation to perform any specific practice. The user is responsible for their health condition, choice of level of load, safety of the space and compliance with safety rules.

YogaJoy practices may be used as part of a personal leisure or wellness routine, but YogaJoy does not guarantee any medical, therapeutic, health, psychological, physical or other specific result.

5. Recommendation to Practice with an Instructor

YogaJoy recommends that users, especially beginners, people with health limitations, injuries, chronic conditions or pregnancy, should not rely only on independent video viewing.

It is recommended to consult a doctor and, if necessary, a qualified yoga instructor or specialist who can personally observe the user, correct technique, control the level of load and take into account the user’s individual condition.

YogaJoy videos, special practices and live online classes may be a useful supporting tool, but they do not replace individual supervision by a specialist when such supervision is necessary due to the user’s health condition or level of preparation.

6. User Account

To access restricted materials, the user must create an account.

The user is responsible for the accuracy of the information provided, keeping their login and password secure, all actions performed through their account and preventing access from being transferred to third parties.

The user may not share their login, password or account access with other people.

YogaJoy may limit or block access in case of violation of these Terms, suspected sharing of access, abuse of the free period or attempts to bypass technical restrictions.

7. Free Trial Access

A new registered user may receive one free trial access to the “Recorded Yoga” section for a period of 30 days.

Free access is granted once per user, cannot be exchanged for money, cannot be transferred to another person and may be terminated in case of abuse, creation of duplicate accounts or violation of the Service terms.

YogaJoy may change the terms of free trial access for new users by publishing the updated terms on the website.

8. Paid Products and Access Periods

YogaJoy may offer paid products, including access to the “Recorded Yoga” section, access to viewing live online classes, access to the club, access to author programs, gift certificates and other products published on the website.

The access period is indicated on the product page and/or during the purchase process.

Different products may have different access periods, for example 30, 90, 180 or 365 days.

Access begins after successful payment, unless otherwise specified for a particular product.

If the user already has active access to the same product, the new paid period may be added to the remaining days of the current access.

9. Product “Yoga”

The product “Yoga” means temporary access to the YogaJoy platform section containing recorded videos of yoga practices, breathing practices, meditations, special practices and related materials.

The user does not purchase individual video files and does not acquire ownership rights to the materials.

The user receives a personal, limited, non-transferable right of online access to the materials of the “Yoga” section for the paid period.

During the active access period, the user may view the available video materials repeatedly and without limitation on the number of views through their personal account.

Downloading, copying, screen recording, distribution, transfer of access to third parties and commercial use of the materials are prohibited.

The materials of the “Yoga” section are informational-entertainment, informational, leisure and practical content. They do not constitute a medical service, medical recommendation or individual consultation.

10. Product “Live Yoga”

The product “Live Yoga” means temporary access to viewing live group online yoga classes conducted via Zoom or another online platform.

To access live yoga, the user must have active access to the relevant product, stable internet connection, a suitable device for connection, installed application or access to the selected online platform, and a safe space for viewing and, if the user independently decides so, for performing the practices.

Within a 30-day access period to live yoga, YogaJoy provides at least 8 live online yoga classes during the access period.

The schedule of classes is published on the website, in the personal account, by email or by another method chosen by YogaJoy.

YogaJoy may change the schedule, reschedule classes, replace the instructor or change the class platform when necessary for organizational, technical or other reasons.

If the user is unable to connect to a class for reasons dependent on the user, including internet, device, Zoom, connection time or personal circumstances, the class is considered to have been made available to the user and does not automatically create a right to a refund.

If YogaJoy, for reasons attributable to YogaJoy, cannot provide the minimum of 8 live classes during the 30-day access period, YogaJoy will provide the user with reasonable compensation, such as rescheduling, a replacement class, extension of access or another option at YogaJoy’s discretion.

During live online classes, the instructor cannot guarantee individual control of the technique and condition of each participant, especially if the participant does not turn on the camera, is outside the field of view, practices in unsuitable conditions or has individual health limitations.

The user views live classes voluntarily and independently decides whether to perform the demonstrated practices. The user is responsible for their health condition, safety of the space and choice of level of load.

11. Author Programs

YogaJoy author programs are provided as temporary online access to a specific program, video materials, audio materials, texts, tasks or other materials indicated on the program page.

The user receives a personal, limited, non-transferable right of access to the author program materials for the specified period or under the conditions published on the product page.

Author programs are informational-entertainment, informational, leisure and practical content and do not constitute medical, therapeutic, diagnostic or individual consulting services.

12. Club

Access to the club may include viewing live online meetings, access to club materials, recordings, Q&A sessions, lectures, discussions and other materials indicated on the product page.

The exact content of club access, meeting schedule and access period are published on the website.

YogaJoy may change the meeting topics, schedule, format and content of the club materials.

13. Gift Certificates

YogaJoy may offer gift certificates.

A gift certificate is generated only after successful payment, is linked to a specific product and a specific access period, contains a unique code, can be activated by the recipient in their personal account, is not a monetary balance, cannot be exchanged for money and cannot be used more than once.

The access period under the certificate begins from the moment the certificate is activated by the recipient, unless otherwise specified for a particular certificate.

If the recipient already has active access to the same product, the certificate period may be added to the remaining days of the current access.

In case of refund or cancellation of the purchase, the certificate may be cancelled.

14. Prices, Payment and Taxes

Current prices and currency are published on the website and displayed to the user before the order is placed.

Payment is made by bank card or another available method through the payment provider Stripe.

YogaJoy does not store users’ full bank card details. Payment data is processed by Stripe in accordance with its security rules.

The price, currency, access period and main product content are displayed before payment.

Unless expressly stated otherwise on the relevant product page, all payments are one-time payments. Automatic access renewal and automatic recurring charges do not apply.

By clicking the payment button, the user confirms that they are placing an order with an obligation to pay.

The product name in the Stripe payment confirmation may differ from the short name shown on the website and may include clarification of the product type, access period, author program name, live online service or other access purchased.

Taxes applicable to the purchase are calculated and displayed in accordance with applicable law, the purchaser’s location, the nature of the product and YogaJoy’s tax status.

15. Digital Content, Start of Services and Right of Withdrawal

15.1. General Rule

A consumer may withdraw from a distance contract within 14 calendar days from the date the contract is concluded, except where the right of withdrawal does not apply, is limited or has been lost under mandatory applicable law.

15.2. Recorded Digital Content

Digital content includes, in particular, the “Recorded Yoga” product, recorded author programs, videos, audio, texts and other materials supplied online without a tangible medium.

Access to digital content may begin immediately after successful payment.

Before receiving immediate access, the user must, through a separate unticked checkbox:

give express consent for the supply of digital content to begin before the end of the 14-day withdrawal period;

confirm that they understand that, once the supply of digital content begins, they lose the right of withdrawal in the cases provided by law.

The separate checkbox will contain the following wording:

“I expressly consent to access to the digital content beginning immediately after payment, before the end of the 14-day withdrawal period, and confirm that I understand that, once the supply of the digital content begins, I lose my right of withdrawal in the cases provided by law.”

Where this consent and acknowledgement have been properly obtained and access has actually been provided, the right of withdrawal for the digital content may be lost in accordance with the law.

15.3. Live Online Services and YogaJoy Club

Services include, in particular, the “Live Yoga” product and live online YogaJoy Club meetings through Zoom or another online platform.

If the user wants the service to begin before the end of the 14-day withdrawal period, they must make a separate express request for the service to begin during that period and confirm that they understand that, once the service has been fully performed, they may lose the right of withdrawal.

The separate checkbox will contain the following wording:

“I expressly request that the service begin immediately after payment, before the end of the 14-day withdrawal period, and understand that, if I withdraw after the service has begun, a proportionate amount for the part already provided may be deducted and that, once the service has been fully performed, I may lose the right of withdrawal.”

If the user validly withdraws from the service after it has begun but before it has been fully performed, YogaJoy may retain a proportionate amount corresponding to the part already provided, to the extent permitted by law.

15.4. Purchase Confirmation

After the contract is concluded, YogaJoy provides the user with confirmation of the purchase on a durable medium, for example by email or in an electronic format that can be retained. The confirmation must include information about the product purchased, the price, the access period and, where applicable, confirmation of the user’s express consent to immediate commencement and acknowledgement of the consequences for the right of withdrawal.

16. Refunds, Cancellations and Complaints

16.1. General Rules

This section applies without prejudice to mandatory consumer rights that cannot be limited by contract.

To request a refund, exercise the right of withdrawal, cancel or request review of a disputed situation, the user must contact:

The request should preferably include:

first and last name;

email associated with the YogaJoy account;

product purchased;

date and amount of payment;

reason for the request;

where available, Stripe payment confirmation.

16.2. “Recorded Yoga” Product and Author Programs

The “Recorded Yoga” product provides temporary online access to recorded videos, yoga practices, breathing practices, meditations, special practices and related materials.

Author programs provide temporary online access to a specific recorded program and its related video, audio and text materials.

Where the user has properly given express consent to the immediate supply of digital content, confirmed their understanding of the loss of the right of withdrawal and access has actually been provided, no refund will be issued solely because the user changes their mind after access begins if the right of withdrawal has been legally lost.

This does not limit the user’s right to request a refund, correction or another remedy provided by law, in particular where:

the user has been charged twice by mistake;

access was not provided for a reason attributable to YogaJoy;

the digital content has a substantial technical defect that YogaJoy has not corrected within a reasonable period;

the product supplied materially differs from its description;

a refund or another remedy is required under applicable law.

16.3. “Live Yoga” Product

The “Live Yoga” product provides temporary access to live group online classes through Zoom or another online platform.

If the user has expressly requested that the service begin before the end of the 14-day withdrawal period and then validly withdraws from the contract during that period, YogaJoy may retain a proportionate amount for the part of the service provided before the withdrawal notice was received.

The calculation may take into account the elapsed portion of the access period and the live classes already held in relation to the full scope of the service purchased.

If a class has taken place and the user did not connect for reasons attributable to the user, including personal circumstances, incorrect time, internet, device, the Zoom application or another platform used, this does not automatically create a right to a refund for that class.

If YogaJoy cancels a class, the user will be offered a reasonable option between:

rescheduling of the class;

a replacement class;

an extension of the access period;

a proportionate refund for the part of the service not provided, where rescheduling, replacement or extension is not possible.

If YogaJoy does not provide the stated minimum of 8 live classes during a 30-day access period and does not offer a reasonable replacement or extension, the user may request a proportionate refund for the part of the service not provided.

If the paid service has not been provided at all for a reason attributable to YogaJoy, the user may request a full refund.

16.4. “YogaJoy Club” Product

The “YogaJoy Club” product provides temporary access to live online club meetings through Zoom or another online platform, Q&A sessions, club materials, recordings and other content indicated on the product page.

If the user does not connect to a scheduled club meeting for reasons attributable to the user, this does not automatically create a right to a refund.

If YogaJoy cancels a club meeting, the user may be offered a new meeting date, a replacement meeting, an extension of the access period or a proportionate refund for the part of the service not provided where replacement or extension is not possible.

If YogaJoy does not effectively provide the stated club service during the paid access period, the user may request a refund for the part not provided and, where the service was not provided at all, a full refund.

16.5. Gift Certificates

A gift certificate is not a monetary balance and is linked to a specific product and a specific access period.

As YogaJoy’s contractual policy, the purchaser may request cancellation and a refund within 14 calendar days of purchase for a certificate that has not been activated or used. If the refund is approved, the certificate and its unique code will be cancelled.

After activation, the refund rules for the product to which the certificate is linked will apply.

This provision neither limits nor expands mandatory consumer rights determined by applicable law.

16.6. Refund Procedure and Timing

Approved refunds are processed through Stripe using the same payment method used for the original purchase, unless another method is expressly agreed with the user or required by law.

Where a valid statutory right of withdrawal is exercised, YogaJoy will make the refund without undue delay and no later than 14 calendar days after receiving the withdrawal notice, taking into account any lawful deduction of the proportionate amount corresponding to the part of the service already provided.

After YogaJoy has initiated the refund, the actual time for the funds to appear depends on Stripe, the user’s bank and the relevant payment network.

16.7. Complaints and Disputed Payments

YogaJoy recommends that, before initiating a bank dispute, the user first contact us at:

We will aim to review the request and provide a response within 10 business days.

Prior contact with YogaJoy is not mandatory and does not limit the user’s right to contact their bank, Stripe, consumer protection authorities, courts or other competent bodies.

Nothing in this section limits mandatory consumer rights that cannot be restricted by contract.

17. Intellectual Property

All YogaJoy materials, including videos, audio, texts, images, design, logos, names, programs, practice sequences and other elements, are protected by copyright and other intellectual property rights.

The user receives a personal, limited, non-transferable right of access to the materials only for personal, non-commercial use.

Without written permission from YogaJoy, it is prohibited to copy materials, download videos or audio unless such function is expressly provided, record the screen, distribute materials, publish materials on the internet, transfer access to third parties, use materials for commercial purposes, conduct classes, courses or programs based on the materials, create derivative products based on YogaJoy materials.

18. Prohibited Use

The user is prohibited from hacking the website or attempting to gain unauthorized access, bypassing technical restrictions, using another person’s account, transferring the account to third parties, copying or distributing restricted content, using the Service for illegal purposes, posting illegal, offensive, harmful or third-party content, performing actions that may disrupt the website, server, payment system or accounts of other users.

19. Technical Availability

YogaJoy strives to ensure stable operation of the Service, but does not guarantee continuous and error-free availability of the website, videos, personal account, Zoom classes, payment system or other technical elements.

Technical interruptions, updates, errors, access restrictions, connection failures, problems on the side of the user, providers, Stripe, Zoom, hosting or other third parties may occur.

YogaJoy is not responsible for inability to access the Service caused by the user’s device, internet connection, browser settings, blocks, failures of third-party services or incorrect use of the platform.

20. Requests, Complaints and Support

YogaJoy will review the request and respond within a reasonable time or within the period required by applicable law.

If the user is a consumer and the dispute is not resolved directly, the user may contact the competent consumer protection authorities.

21. Privacy and Personal Data

By registering, the user confirms that they have been informed about the Privacy Policy.

Consent to receive news, newsletters and marketing communications must be given separately and is not a mandatory condition for using the Service, unless otherwise provided by law.

22. Cookies

The use of cookies and similar technologies is described in the separate Cookie Policy.

23. No Warranties

The Service is provided “as is” and “as available”, to the extent permitted by law.

YogaJoy does not guarantee achievement of any specific physical, psychological, wellness or other result, improvement of health, absence of discomfort, absence of technical errors, permanent availability of all materials or compatibility of the Service with all devices and browsers.

This does not limit mandatory consumer rights, including rights that cannot be limited by law.

24. Limitation of Liability

To the extent permitted by law, YogaJoy is not liable for injuries, worsening of well-being or harm to health during independent performance of practices, incorrect choice of level of load by the user, ignoring medical contraindications, failure by the user to follow safety rules, lack of individual control by the instructor, technical failures on the side of the user or third-party services, actions of payment systems, internet providers, Zoom, hosting and other third parties, indirect damages, loss of profit or inability to use the Service for reasons beyond YogaJoy’s control.

Nothing in these Terms limits liability that cannot be limited by law.

25. Changes to the Terms

YogaJoy may update these Terms of Use, the website functionality, product content, prices, schedule, access rules and other conditions.

The current version of the Terms is published on the website with the effective date.

Continued use of the Service after publication of the updated version means acceptance of the updated terms, unless applicable law requires otherwise.

26. Suspension or Termination of Access

YogaJoy may temporarily limit, suspend or terminate the user’s access to the Service in case of violation of these Terms, transfer of access to third parties, attempt to copy or distribute materials, abuse of free access, fraudulent actions, violation of payment rules, actions that threaten the operation of the Service or the rights of other users.

27. Language Versions

These Terms may be available in Russian, Spanish, English or other languages.

The main legal version is the Spanish version.

In case of discrepancies between language versions, the Spanish version shall prevail, unless mandatory consumer protection rules provide otherwise.

28. Governing Law and Disputes

These Terms are governed by the laws of Spain and applicable European Union law.

If the user is a consumer, mandatory consumer protection and jurisdiction rules that cannot be limited by contract shall apply.

If the user acts as a business, professional or organization, disputes shall be submitted to the competent courts of Spain at the place of establishment of the Service owner, unless mandatory law provides otherwise.
