Настоящая Политика регулирует порядок отказа от договора, возврата денежных средств и рассмотрения обращений по продуктам и услугам, приобретённым на сайте YogaJoy:

YogaJoy является коммерческим обозначением поставщика услуг, юридические и контактные данные которого указаны в нижней части сайта.

1. Общие положения

Покупатель вправе отказаться от дистанционного договора в течение установленного законом срока.

Условия возврата зависят от вида приобретённого продукта, даты покупки и обстоятельств обращения.

Настоящая Политика не ограничивает права потребителей, предоставленные обязательными нормами законодательства Испании, Европейского союза и страны постоянного проживания потребителя.

Если положения настоящей Политики противоречат обязательным нормам применимого законодательства, применяются соответствующие обязательные нормы.

2. Право на отказ от дистанционного договора

Покупатель вправе отказаться от дистанционного договора в течение 14 календарных дней без объяснения причин.

Срок для отказа исчисляется со дня заключения договора, то есть со дня успешной оплаты продукта или услуги.

Для осуществления права на отказ покупатель должен до истечения 14 календарных дней направить YogaJoy однозначное заявление о решении отказаться от покупки.

Заявление можно направить:

·        через форму поддержки: https://yogajoy.space/support;

·        по электронной почте: support@yogajoy.space.

Заявление составляется в свободной форме. В нём необходимо ясно указать решение отказаться от покупки и сведения, позволяющие определить покупателя и соответствующий платёж.

Покупателю не требуется объяснять причину отказа.

3. Цифровой контент YogaJoy

К цифровому контенту YogaJoy относятся:

·        йога-практики в записи;

·        медитации в записи;

·        дыхательные практики в записи;

·        специальные практики в записи;

·        платные лекции и иные материалы в записи;

·        авторские программы в записи;

·        другие видео-, аудио- и текстовые материалы, доступные через сайт.

Доступ к цифровому контенту открывается сразу после подтверждения успешной оплаты, если на странице конкретного продукта не указан другой срок.

Покупатель сохраняет право отказаться от приобретённого цифрового контента в течение 14 календарных дней со дня оплаты.

Для осуществления права на отказ покупателю не требуется заранее подтверждать отказ от этого права или устанавливать дополнительные отметки перед оплатой.

После получения заявления об отказе YogaJoy прекращает доступ покупателя к соответствующему цифровому контенту и оформляет возврат денежных средств в порядке, установленном настоящей Политикой.

После направления заявления об отказе покупатель обязан прекратить использование цифрового контента и не вправе копировать, распространять, передавать или иным образом использовать материалы YogaJoy.

4. Живые онлайн-практики

Живые онлайн-практики проводятся в режиме реального времени через приложение Zoom по расписанию, опубликованному на платформе YogaJoy.

Доступ к живым практикам открывается после подтверждения успешной оплаты и действует в течение приобретённого периода:

·        30 дней;

·        90 дней;

·        180 дней;

·        365 дней.

Покупатель вправе отказаться от приобретённого доступа в течение 14 календарных дней со дня оплаты.

Право на отказ сохраняется независимо от того, был ли доступ уже открыт и участвовал ли покупатель в отдельных живых практиках в течение этого срока.

После получения заявления об отказе YogaJoy прекращает доступ покупателя к живым практикам и оформляет возврат денежных средств.

По истечении 14 календарных дней возврат в связи с обычным изменением решения покупателя не производится. При этом сохраняется право на возврат в случаях, предусмотренных настоящей Политикой и применимым законодательством.

5. Клуб YogaJoy

Доступ к Клубу YogaJoy может включать:

·        клубные онлайн-встречи;

·        живые практики, входящие в программу клуба;

·        возможность заранее направлять вопросы по теме встречи;

·        доступ к закрытым материалам;

·        доступ к архиву проведённых встреч в качестве дополнительного преимущества.

Доступ предоставляется на выбранный покупателем срок:

·        30 дней;

·        90 дней;

·        180 дней;

·        365 дней.

Покупатель вправе отказаться от приобретённого доступа к Клубу YogaJoy в течение 14 календарных дней со дня оплаты.

После получения заявления об отказе YogaJoy прекращает доступ покупателя к клубным встречам, живым практикам и закрытым материалам и оформляет возврат денежных средств.

Пропуск отдельной клубной встречи или живой практики после окончания срока отказа не является самостоятельным основанием для возврата.

6. Авторские программы

Авторские программы YogaJoy предоставляются в виде цифрового видеоконтента в записи и не включают живые занятия.

Доступ к авторской программе открывается после успешной оплаты, если на странице конкретной программы не указано иное.

Покупатель вправе отказаться от приобретённой авторской программы в течение 14 календарных дней со дня оплаты.

После получения заявления об отказе YogaJoy прекращает доступ к соответствующей авторской программе и оформляет возврат денежных средств.

К авторским программам применяются правила настоящей Политики, установленные для цифрового контента.

7. Подарочные сертификаты

Подарочный сертификат YogaJoy предоставляет право активировать доступ к указанному в сертификате продукту.

Срок активации сертификата составляет 365 дней со дня покупки.

Код подарочного сертификата:

·        может быть активирован только один раз;

·        активируется зарегистрированным пользователем в личном кабинете;

·        после активации предоставляет доступ к продукту на указанный в сертификате срок.

Покупатель вправе отказаться от покупки подарочного сертификата в течение 14 календарных дней со дня оплаты.

Если сертификат не был активирован, после получения заявления об отказе YogaJoy аннулирует код и оформляет возврат первоначальному покупателю.

Если сертификат был активирован в течение 14-дневного срока, YogaJoy прекращает предоставленный по сертификату доступ, аннулирует код и оформляет возврат первоначальному покупателю.

Возврат всегда производится первоначальному покупателю на тот же способ оплаты, которым был приобретён сертификат.

Бесплатные сертификаты и сертификаты с нулевой стоимостью не предусматривают денежной компенсации.

8. Случаи, когда возврат возможен

Возврат производится полностью или, когда это предусмотрено законом или согласовано с покупателем, частично, в частности, если:

·        покупатель воспользовался правом на отказ в течение 14 календарных дней;

·        произошло повторное списание;

·        платёж был списан ошибочно;

·        была списана сумма, отличающаяся от цены, подтверждённой перед оплатой;

·        оплата была получена, но доступ не был предоставлен по технической причине на стороне YogaJoy;

·        YogaJoy не может предоставить приобретённый продукт или услугу;

·        продукт существенно не соответствует опубликованному описанию;

·        доступ был прекращён по ошибке YogaJoy и не был восстановлен в разумный срок;

·        возврат обязателен по применимому законодательству;

·        YogaJoy одобрил возврат после индивидуального рассмотрения обращения.

9. Случаи, когда возврат обычно не производится

После истечения 14 календарных дней возврат обычно не производится, если:

·        покупатель изменил решение о покупке;

·        покупатель не воспользовался предоставленным доступом;

·        покупатель редко пользовался приобретённым продуктом;

·        покупатель пропустил живую практику или клубную встречу, состоявшуюся по расписанию;

·        невозможность использования связана с устройством, программным обеспечением, настройками или интернет-соединением покупателя;

·        доступ был прекращён из-за существенного нарушения Пользовательского соглашения;

·        обращение относится к бесплатному доступу или сертификату с нулевой стоимостью;

·        обстоятельства, указанные покупателем, не подтверждаются сведениями об оплате и предоставлении доступа.

Настоящий раздел не применяется в случаях, когда возврат обязателен по применимому законодательству.

10. Технические проблемы

При возникновении технической проблемы покупателю рекомендуется сообщить в службу поддержки:

·        имя;

·        email аккаунта YogaJoy;

·        название приобретённого продукта;

·        описание проблемы;

·        дату и примерное время возникновения ошибки;

·        используемое устройство и браузер;

·        скриншот ошибки, если он имеется.

YogaJoy может предложить:

·        восстановление доступа;

·        исправление технической ошибки;

·        повторное предоставление доступа;

·        продление срока доступа;

·        альтернативный способ получения приобретённого материала.

Если техническая проблема возникла на стороне YogaJoy, не была устранена и приобретённый продукт фактически не был предоставлен, покупатель вправе потребовать возврат денежных средств.

11. Порядок подачи заявления

Для отказа от покупки или подачи запроса на возврат покупателю необходимо обратиться:

·        через страницу поддержки: https://yogajoy.space/support;

·        по электронной почте: support@yogajoy.space.

В обращении рекомендуется указать:

·        имя и фамилию;

·        email, использованный при регистрации или покупке;

·        название приобретённого продукта;

·        дату оплаты;

·        сумму оплаты;

·        содержание требования;

·        при необходимости — описание проблемы и подтверждающие материалы.

Отсутствие отдельных сведений не лишает покупателя права на обращение, однако YogaJoy может запросить дополнительную информацию, необходимую для определения платежа и проверки обстоятельств.

Датой обращения считается день отправки заявления покупателем.

12. Срок рассмотрения обращения

YogaJoy подтверждает получение обращения и предоставляет первоначальный ответ, как правило, в течение двух рабочих дней.

Если для рассмотрения обращения требуется дополнительная техническая или платёжная проверка, YogaJoy уведомляет об этом покупателя по электронной почте.

Срок ответа службы поддержки не изменяет установленные законом сроки возврата денежных средств.

13. Способ и срок возврата

Если покупатель воспользовался правом на отказ или возврат был одобрен по другому основанию, YogaJoy оформляет возврат без необоснованной задержки и не позднее 14 календарных дней со дня получения заявления, если применимым законодательством не предусмотрено иное.

Возврат производится:

·        через Stripe;

·        на тот же способ оплаты, который использовался при покупке;

·        в той же валюте, в которой была произведена оплата;

·        без дополнительной комиссии со стороны YogaJoy за оформление возврата.

Перевод возврата на другую карту, другой банковский счёт или иной способ оплаты не производится.

После оформления возврата срок фактического зачисления денежных средств зависит от банка, платёжной системы и эмитента карты покупателя.

YogaJoy не может повлиять на сроки обработки уже отправленного возврата банком или платёжной системой.

14. Платёжные споры

Если у покупателя возник вопрос по оплате, предоставлению доступа или возврату, рекомендуется сначала обратиться в YogaJoy:

YogaJoy проверит:

·        факт оплаты;

·        сумму и валюту платежа;

·        приобретённый продукт;

·        дату предоставления доступа;

·        технические данные;

·        обстоятельства обращения.

Предварительное обращение в YogaJoy не ограничивает право покупателя обратиться в банк, платёжную систему, службу защиты потребителей или иной компетентный орган.

Предоставление заведомо недостоверной информации при оспаривании платежа за фактически приобретённый продукт может рассматриваться как нарушение Пользовательского соглашения.

15. Подтверждение покупки

После успешной оплаты покупателю направляется электронное подтверждение, которое может содержать:

·        название приобретённого продукта;

·        сумму и валюту платежа;

·        дату оплаты;

·        срок предоставленного доступа;

·        сведения о начале доступа;

·        ссылку на настоящую Политику;

·        контактные данные службы поддержки.

В подтверждение покупки не включается утверждение о том, что покупатель отказался от 14-дневного права на отказ.

16. Изменения Политики

YogaJoy вправе обновлять настоящую Политику при изменении законодательства, состава продуктов, технических условий или порядка предоставления услуг.

К покупке применяется версия Политики, действовавшая на момент оформления заказа, если обязательным законодательством не предусмотрено иное.

1. Disposiciones generales

El comprador podrá desistir de un contrato celebrado a distancia dentro del plazo legal aplicable.

Las condiciones del reembolso dependen del tipo de producto adquirido, de la fecha de compra y de las circunstancias de la solicitud.

Esta Política no limita los derechos de los consumidores reconocidos por las normas imperativas de España, de la Unión Europea y del país de residencia habitual del consumidor.

Si alguna disposición de esta Política entra en conflicto con una norma imperativa aplicable, prevalecerá dicha norma.

2. Derecho de desistimiento

El comprador podrá desistir del contrato celebrado a distancia dentro de los 14 días naturales siguientes, sin necesidad de indicar el motivo.

El plazo de desistimiento se contará desde la fecha de celebración del contrato, es decir, desde la fecha en que el pago del producto o servicio se haya realizado correctamente.

Para ejercer el derecho de desistimiento, el comprador deberá enviar a YogaJoy, antes de que finalice el plazo de 14 días naturales, una declaración inequívoca de su decisión de desistir de la compra.

La declaración podrá enviarse:

·        mediante el formulario de asistencia: https://yogajoy.space/support;

·        por correo electrónico: support@yogajoy.space.

La declaración podrá redactarse libremente. Deberá expresar claramente la decisión de desistir de la compra e incluir la información necesaria para identificar al comprador y el pago correspondiente.

El comprador no está obligado a explicar el motivo del desistimiento.

3. Contenido digital de YogaJoy

Se considera contenido digital de YogaJoy:

·        prácticas de yoga grabadas;

·        meditaciones grabadas;

·        prácticas de respiración grabadas;

·        prácticas especiales grabadas;

·        conferencias de pago y otros materiales grabados;

·        programas de autor grabados;

·        otros materiales de vídeo, audio y texto disponibles a través del sitio web.

El acceso al contenido digital se abre inmediatamente después de la confirmación correcta del pago, salvo que en la página del producto se indique otro plazo.

El comprador conserva el derecho a desistir del contenido digital adquirido dentro de los 14 días naturales siguientes al pago.

Para ejercer este derecho, el comprador no tiene que renunciar previamente a él ni marcar casillas adicionales antes del pago.

Una vez recibida la declaración de desistimiento, YogaJoy cancelará el acceso al contenido digital correspondiente y tramitará el reembolso conforme a esta Política.

Después de enviar la declaración de desistimiento, el comprador deberá dejar de utilizar el contenido digital y no podrá copiar, distribuir, transmitir ni utilizar de otro modo los materiales de YogaJoy.

4. Prácticas online en directo

Las prácticas online en directo se realizan en tiempo real mediante la aplicación Zoom, conforme al calendario publicado en la plataforma YogaJoy.

El acceso a las prácticas en directo se activa una vez confirmado correctamente el pago y se mantiene durante el período adquirido:

·        30 días;

·        90 días;

·        180 días;

·        365 días.

El comprador podrá desistir del acceso adquirido dentro de los 14 días naturales siguientes al pago.

El derecho de desistimiento se mantiene aunque el acceso ya se haya activado o el comprador haya participado en alguna práctica en directo durante ese plazo.

Una vez recibida la declaración de desistimiento, YogaJoy cancelará el acceso a las prácticas en directo y tramitará el reembolso.

Transcurridos los 14 días naturales, no se realizará un reembolso por un simple cambio de decisión del comprador. Se mantienen, no obstante, los derechos de reembolso previstos en esta Política y en la legislación aplicable.

5. Club YogaJoy

El acceso al Club YogaJoy puede incluir:

·        encuentros online del club;

·        prácticas en directo incluidas en el programa del club;

·        posibilidad de enviar preguntas previamente sobre el tema del encuentro;

·        acceso a materiales cerrados;

·        acceso al archivo de encuentros celebrados como ventaja adicional.

El acceso se ofrece durante el período elegido por el comprador:

·        30 días;

·        90 días;

·        180 días;

·        365 días.

El comprador podrá desistir del acceso al Club YogaJoy dentro de los 14 días naturales siguientes al pago.

Una vez recibida la declaración de desistimiento, YogaJoy cancelará el acceso a los encuentros del club, a las prácticas en directo y a los materiales cerrados, y tramitará el reembolso.

La falta de asistencia a un encuentro del club o a una práctica en directo, una vez finalizado el plazo de desistimiento, no constituye por sí sola un motivo de reembolso.

6. Programas de autor

Los programas de autor de YogaJoy se ofrecen exclusivamente como contenido digital de vídeo grabado y no incluyen sesiones en directo.

El acceso al programa de autor se activa después del pago correcto, salvo que en la página del programa se indique otro plazo.

El comprador podrá desistir del programa adquirido dentro de los 14 días naturales siguientes al pago.

Una vez recibida la declaración de desistimiento, YogaJoy cancelará el acceso al programa correspondiente y tramitará el reembolso.

A los programas de autor se les aplican las reglas de esta Política relativas al contenido digital.

7. Certificados regalo

El certificado regalo YogaJoy permite activar el acceso al producto indicado en el certificado.

El plazo de activación del certificado es de 365 días desde la fecha de compra.

El código del certificado:

·        solo puede activarse una vez;

·        lo activa un usuario registrado desde su cuenta personal;

·        tras la activación, concede acceso al producto durante el plazo indicado en el certificado.

El comprador podrá desistir de la compra del certificado regalo dentro de los 14 días naturales siguientes al pago.

Si el certificado no se ha activado, YogaJoy anulará el código y tramitará el reembolso al comprador original.

Si el certificado se ha activado dentro del plazo de 14 días, YogaJoy cancelará el acceso concedido mediante el certificado, anulará el código y tramitará el reembolso al comprador original.

El reembolso siempre se realizará al comprador original y al mismo método de pago utilizado para adquirir el certificado.

Los certificados gratuitos o de valor cero no dan derecho a compensación económica.

8. Casos en los que procede el reembolso

El reembolso podrá realizarse de forma total o, cuando la ley lo permita o se acuerde con el comprador, de forma parcial, entre otros, en los siguientes casos:

·        el comprador ejerció su derecho de desistimiento dentro de los 14 días naturales;

·        se produjo un cargo duplicado;

·        el pago se cargó por error;

·        se cargó un importe distinto al precio confirmado antes del pago;

·        el pago fue recibido, pero el acceso no se concedió por un problema técnico imputable a YogaJoy;

·        YogaJoy no puede prestar el producto o servicio adquirido;

·        el producto difiere sustancialmente de la descripción publicada;

·        el acceso se canceló por error de YogaJoy y no se restableció en un plazo razonable;

·        el reembolso es obligatorio conforme a la legislación aplicable;

·        YogaJoy aprobó el reembolso tras revisar individualmente la solicitud.

9. Casos en los que normalmente no procede el reembolso

Una vez transcurridos los 14 días naturales, normalmente no se realizará el reembolso si:

·        el comprador cambió de opinión sobre la compra;

·        el comprador no utilizó el acceso concedido;

·        el comprador utilizó el producto con poca frecuencia;

·        el comprador faltó a una práctica en directo o a un encuentro del club celebrados según el calendario;

·        la imposibilidad de uso se debe al dispositivo, software, configuración o conexión a Internet del comprador;

·        el acceso se canceló por un incumplimiento grave de las Condiciones de uso;

·        la solicitud se refiere a un acceso gratuito o a un certificado de valor cero;

·        las circunstancias alegadas no quedan acreditadas por los datos de pago y de acceso.

Este apartado no se aplicará cuando el reembolso sea obligatorio conforme a la legislación aplicable.

10. Problemas técnicos

En caso de problema técnico, se recomienda al comprador comunicar al servicio de asistencia:

·        nombre;

·        correo electrónico de la cuenta YogaJoy;

·        nombre del producto adquirido;

·        descripción del problema;

·        fecha y hora aproximada del error;

·        dispositivo y navegador utilizados;

·        captura de pantalla del error, si existe.

YogaJoy podrá ofrecer:

·        restablecimiento del acceso;

·        corrección del error técnico;

·        nueva concesión del acceso;

·        ampliación del plazo de acceso;

·        una forma alternativa de recibir el material adquirido.

Si el problema técnico es imputable a YogaJoy, no se corrige y el producto adquirido no se ha prestado realmente, el comprador podrá solicitar el reembolso.

11. Cómo presentar una solicitud

Para desistir de la compra o solicitar un reembolso, el comprador deberá ponerse en contacto:

·        a través de la página de asistencia: https://yogajoy.space/support;

·        por correo electrónico: support@yogajoy.space.

Se recomienda incluir en la solicitud:

·        nombre y apellidos;

·        correo electrónico utilizado para el registro o la compra;

·        nombre del producto adquirido;

·        fecha del pago;

·        importe pagado;

·        contenido de la solicitud;

·        si procede, descripción del problema y documentos justificativos.

La falta de alguno de estos datos no priva al comprador del derecho a presentar la solicitud, aunque YogaJoy podrá pedir información adicional necesaria para localizar el pago y verificar las circunstancias.

La fecha de la solicitud será la fecha en que el comprador la envíe.

12. Plazo de respuesta

YogaJoy confirmará la recepción de la solicitud y proporcionará una primera respuesta, por regla general, en un plazo de dos días laborables.

Si fuera necesaria una comprobación técnica o de pago adicional, YogaJoy informará al comprador por correo electrónico.

El plazo de respuesta del servicio de asistencia no modifica los plazos legales aplicables al reembolso.

13. Forma y plazo del reembolso

Si el comprador ejerce su derecho de desistimiento o el reembolso se aprueba por otro motivo, YogaJoy lo tramitará sin demora indebida y, como máximo, dentro de los 14 días naturales siguientes a la recepción de la solicitud, salvo que la legislación aplicable disponga otra cosa.

El reembolso se realizará:

·        a través de Stripe;

·        al mismo método de pago utilizado en la compra;

·        en la misma moneda en la que se realizó el pago;

·        sin comisión adicional de YogaJoy por tramitar el reembolso.

No se transferirá el reembolso a otra tarjeta, otra cuenta bancaria ni a otro método de pago.

Una vez tramitado el reembolso, el plazo efectivo de abono dependerá del banco, del sistema de pago y del emisor de la tarjeta del comprador.

YogaJoy no puede influir en los plazos de procesamiento del banco o del sistema de pago una vez enviado el reembolso.

14. Disputas de pago

Si el comprador tiene alguna duda sobre el pago, el acceso o el reembolso, se recomienda que contacte primero con YogaJoy:

YogaJoy comprobará:

·        la existencia del pago;

·        el importe y la moneda;

·        el producto adquirido;

·        la fecha de concesión del acceso;

·        los datos técnicos;

·        las circunstancias de la solicitud.

El contacto previo con YogaJoy no limita el derecho del comprador a dirigirse a su banco, al sistema de pago, a una autoridad de protección de consumidores o a cualquier otro organismo competente.

La presentación deliberada de información falsa al impugnar un pago correspondiente a un producto realmente adquirido podrá considerarse un incumplimiento de las Condiciones de uso.

15. Confirmación de la compra

Tras el pago correcto, el comprador recibirá una confirmación electrónica que podrá incluir:

·        nombre del producto adquirido;

·        importe y moneda del pago;

·        fecha del pago;

·        duración del acceso concedido;

·        información sobre el inicio del acceso;

·        enlace a esta Política;

·        datos de contacto del servicio de asistencia.

La confirmación de compra no indicará que el comprador haya renunciado a su derecho de desistimiento de 14 días.

16. Modificaciones de la Política

YogaJoy podrá actualizar esta Política cuando cambien la legislación, los productos, las condiciones técnicas o la forma de prestación de los servicios.

A cada compra se le aplicará la versión de la Política vigente en el momento de realizar el pedido, salvo que la legislación imperativa disponga otra cosa.

This Policy does not restrict consumer rights granted by the mandatory laws of Spain, the European Union, or the consumer’s country of habitual residence.

If any provision of this Policy conflicts with applicable mandatory law, the mandatory law shall prevail.

2. Right of withdrawal

The buyer may withdraw from a distance contract within 14 calendar days without giving any reason.

The withdrawal period begins on the date the contract is concluded, meaning the date on which payment for the product or service is successfully completed.

To exercise the right of withdrawal, the buyer must send YogaJoy an unambiguous statement of the decision to withdraw from the purchase before the end of the 14-calendar-day period.

The statement may be sent:

·        through the support form: https://yogajoy.space/support;

·        by email: support@yogajoy.space.

The statement may be written in free form. It must clearly state the decision to withdraw from the purchase and include enough information to identify the buyer and the relevant payment.

The buyer is not required to explain the reason for withdrawal.

3. YogaJoy digital content

YogaJoy digital content includes:

·        recorded yoga practices;

·        recorded meditations;

·        recorded breathing practices;

·        recorded special practices;

·        paid lectures and other recorded materials;

·        recorded author programs;

·        other video, audio, and text materials available through the website.

Access to digital content is opened immediately after successful payment confirmation unless a different start time is stated on the relevant product page.

The buyer retains the right to withdraw from the purchased digital content within 14 calendar days from the payment date.

To exercise this right, the buyer does not have to waive it in advance or tick any additional boxes before payment.

After receiving the withdrawal statement, YogaJoy will terminate access to the relevant digital content and process the refund in accordance with this Policy.

After submitting the withdrawal statement, the buyer must stop using the digital content and may not copy, distribute, transmit, or otherwise use YogaJoy materials.

4. Live online practices

Live online practices are delivered in real time through the Zoom application according to the schedule published on the YogaJoy platform.

Access to live practices is activated after successful payment confirmation and remains available for the purchased period:

·        30 days;

·        90 days;

·        180 days;

·        365 days.

The buyer may withdraw from the purchased access within 14 calendar days from the payment date.

The right of withdrawal remains available even if access has already been activated or the buyer has participated in individual live practices during that period.

After receiving the withdrawal statement, YogaJoy will terminate the buyer’s access to live practices and process the refund.

After the 14-calendar-day period has expired, a refund is not provided merely because the buyer changed their mind. The buyer’s rights to a refund under this Policy and applicable law remain unaffected.

5. YogaJoy Club

Access to the YogaJoy Club may include:

·        online club meetings;

·        live practices included in the club program;

·        the ability to submit questions in advance on the meeting topic;

·        access to restricted materials;

·        access to the archive of past meetings as an additional benefit.

Access is provided for the period selected by the buyer:

·        30 days;

·        90 days;

·        180 days;

·        365 days.

The buyer may withdraw from access to the YogaJoy Club within 14 calendar days from the payment date.

After receiving the withdrawal statement, YogaJoy will terminate access to club meetings, live practices, and restricted materials and will process the refund.

Missing an individual club meeting or live practice after the withdrawal period has expired is not, by itself, a ground for a refund.

6. Author programs

YogaJoy author programs are provided exclusively as recorded digital video content and do not include live sessions.

Access to an author program is activated after successful payment unless a different start time is stated on the relevant program page.

The buyer may withdraw from the purchased author program within 14 calendar days from the payment date.

After receiving the withdrawal statement, YogaJoy will terminate access to the relevant author program and process the refund.

Author programs are governed by the provisions of this Policy applicable to digital content.

7. Gift certificates

A YogaJoy gift certificate gives the right to activate access to the product specified in the certificate.

The certificate must be activated within 365 days from the purchase date.

The certificate code:

·        may be activated only once;

·        is activated by a registered user through the personal account;

·        after activation, provides access to the product for the period stated in the certificate.

The buyer may withdraw from the purchase of a gift certificate within 14 calendar days from the payment date.

If the certificate has not been activated, YogaJoy will cancel the code and process the refund to the original buyer.

If the certificate was activated during the 14-day period, YogaJoy will terminate the access granted through the certificate, cancel the code, and process the refund to the original buyer.

The refund is always made to the original buyer and to the same payment method used to purchase the certificate.

Free certificates and certificates with a zero value do not entitle the holder to monetary compensation.

8. Cases in which a refund may be granted

A refund may be made in full or, where permitted by law or agreed with the buyer, in part, including in the following cases:

·        the buyer exercised the right of withdrawal within 14 calendar days;

·        a duplicate charge occurred;

·        the payment was charged in error;

·        an amount different from the price confirmed before payment was charged;

·        payment was received but access was not provided because of a technical issue on YogaJoy’s side;

·        YogaJoy cannot provide the purchased product or service;

·        the product materially differs from its published description;

·        access was terminated by YogaJoy in error and was not restored within a reasonable time;

·        a refund is required by applicable law;

·        YogaJoy approved the refund after individually reviewing the request.

9. Cases in which refunds are normally not granted

After the 14-calendar-day period has expired, a refund is normally not granted where:

·        the buyer changed their mind about the purchase;

·        the buyer did not use the access provided;

·        the buyer used the purchased product infrequently;

·        the buyer missed a live practice or club meeting that took place according to schedule;

·        the inability to use the product is caused by the buyer’s device, software, settings, or internet connection;

·        access was terminated because of a material breach of the Terms of Use;

·        the request concerns free access or a zero-value certificate;

·        the circumstances stated by the buyer are not supported by payment and access records.

This section does not apply where a refund is mandatory under applicable law.

10. Technical problems

If a technical problem occurs, the buyer is advised to provide customer support with:

·        name;

·        email address of the YogaJoy account;

·        name of the purchased product;

·        description of the problem;

·        date and approximate time of the error;

·        device and browser used;

·        a screenshot of the error, if available.

YogaJoy may offer:

·        restoration of access;

·        correction of the technical issue;

·        regranting access;

·        extension of the access period;

·        an alternative way to receive the purchased material.

If the technical issue is on YogaJoy’s side, is not resolved, and the purchased product was not actually provided, the buyer may request a refund.

11. How to submit a request

To withdraw from a purchase or request a refund, the buyer must contact YogaJoy:

·        through the support page: https://yogajoy.space/support;

·        by email: support@yogajoy.space.

The request should preferably include:

·        first and last name;

·        email address used for registration or purchase;

·        name of the purchased product;

·        payment date;

·        payment amount;

·        the buyer’s request;

·        where relevant, a description of the problem and supporting materials.

Omission of some information does not deprive the buyer of the right to submit a request, although YogaJoy may ask for additional information needed to identify the payment and verify the circumstances.

The request date is the date on which the buyer sends it.

12. Response time

YogaJoy will confirm receipt of the request and normally provide an initial response within two business days.

If additional technical or payment verification is required, YogaJoy will inform the buyer by email.

The customer support response time does not alter any statutory refund deadlines.

13. Refund method and timing

If the buyer exercises the right of withdrawal or the refund is approved on another basis, YogaJoy will process the refund without undue delay and no later than 14 calendar days after receiving the request, unless applicable law provides otherwise.

The refund will be made:

·        through Stripe;

·        to the same payment method used for the purchase;

·        in the same currency in which the payment was made;

·        without any additional YogaJoy fee for processing the refund.

The refund will not be transferred to another card, another bank account, or another payment method.

After the refund has been processed, the actual time required for the funds to reach the buyer depends on the bank, payment system, and card issuer.

YogaJoy cannot influence the processing time of the bank or payment system after the refund has been sent.

14. Payment disputes

If the buyer has a question about payment, access, or a refund, the buyer is advised to contact YogaJoy first:

YogaJoy will check:

·        whether payment was received;

·        the payment amount and currency;

·        the purchased product;

·        the date access was provided;

·        technical records;

·        the circumstances of the request.

Contacting YogaJoy first does not limit the buyer’s right to contact the bank, payment system, consumer protection authority, or another competent body.

Knowingly providing false information when disputing payment for a product that was actually purchased may be treated as a breach of the Terms of Use.

15. Purchase confirmation

After successful payment, the buyer will receive an electronic confirmation that may include:

·        the name of the purchased product;

·        the payment amount and currency;

·        the payment date;

·        the duration of the access granted;

·        information about when access began;

·        a link to this Policy;

·        customer support contact details.

The purchase confirmation will not state that the buyer waived the 14-day right of withdrawal.

16. Changes to this Policy

YogaJoy may update this Policy if the law, products, technical conditions, or service delivery arrangements change.

The version of this Policy in effect at the time of purchase applies to that purchase, unless mandatory law provides otherwise.
